<text>A financial audit of the Fair Elections Program; and</text>

<heading>Short title.</heading>
<text>This subtitle may be cited as the "Procurement Practices Reform Exemption Amendment Act of 2018".</text>

<num>1012</num>
<text>Section 3 of the Procurement Practices Reform Exemption Amendment Act of 2014, effective March 14, 2014 (D.C. Law 20-94; 61 DCR 963), is amended by striking the phrase "at the end of fiscal year 2018" and inserting the phrase "on September 30, 2023" in its place.</text>

<heading>PROJECT LABOR AGREEMENT PROCUREMENT FUNDING</heading>

<heading>Short title.</heading>
<text>This subtitle may be cited as the "Project Labor Agreements in Construction Procurement Amendment Act of 2018".</text>

<num>1022</num>
<text>Section 47-339.01(a) of the District of Columbia Official Code is amended by adding a new paragraph (3) to read follows:</text>

<text>For a capital project meeting the requirements of <cite doc="D.C. Code" path="§2-356.06|(a)|(3)">§ 2-356.06(a)(3)</cite>, the estimated fully funded cost information provided pursuant to paragraph (1)(C) of this subsection shall account for the cost of compliance with the requirements of <cite doc="D.C. Code" path="§2-356.06">§ 2-356.06</cite> in an amount equal to 10% of the total estimated cost of the project or some other amount determined to be sufficient by the Mayor.</text>

<num>(B)</num>
<text>This paragraph shall apply to capital projects for which construction costs will be incurred beginning in or after Fiscal Year 2020.</text>

<para>
<num>(E)</num>
<text>Any school, library, or other building primarily used for the instruction of students, including a day care center, nursery, elementary school, secondary school, college, and university;</text>
</para>
<para>
<num>(F)</num>
<text>Any bank, health care facility, laundromat, retail store, shopping mall, sports arena, music venue, and theater;</text>
</para>
<para>
<num>(G)</num>
<text>All the publicly owned property between property lines shown on the records of the District, including any roadway, sidewalk, or parking between such property lines; and</text>
</para>
<para>
<num>(H)</num>
<text>All buildings or land that are owned, leased, or occupied by the District government.</text>
</para>
</para>
<para>
<num>(3)</num>
<text>"OHR" means the Office of Human Rights established by <code-cite doc="D.C. Code" path="§2-1411.01">section 202 of the Office of Human Rights Establishment Act of 1999, effective October 20, 1999 (D.C. Law 13-38; D.C. Official Code § 2-1411.01)</code-cite>.</text>

<num>(4)</num>
<text>"Street harassment" means disrespectful, offensive, or threatening statements, gestures, or other conduct directed at an individual in a high-risk area without the individual's consent and based on the individual's actual or perceived ethnicity or housing status, or a protected trait identified in the <code-cite doc="D.C. Code" path="2|14|A">Human Rights Act of 1977, effective December 13, 1977 (D.C. Law 2-38; D.C. Official Code § 2-1401.01 <em>et seq.</em>)</code-cite>.</text>

<num>(a)</num>
<text>There is established an Advisory Committee on Street Harassment, which shall be composed of 17 members as follows:</text>

<num>(1)</num>
<text>The Director of OHR, or the Director's designee;</text>
</para>
<para>
<num>(2)</num>
<text>The Director of the Office of Victim Services and Justice Grants, or the Director's designee;</text>
</para>
<para>
<num>(3)</num>
<text>The Director of the Mayor's Office of Lesbian, Gay, Bisexual, Transgender and Questioning Affairs, or the Director's designee;</text>
</para>
<para>
<num>(4)</num>
<text>The Director of the District Department of Transportation, or the Director's designee;</text>
</para>
<para>
<num>(5)</num>
<text>The Chief of the Metropolitan Police Department, or the Chief's designee;</text>
</para>
<para>
<num>(6)</num>
<text>The Chairman of the Council, or the Chairman's designee;</text>
</para>
<para>
<num>(7)</num>
<text>The General Manager of the Washington Metropolitan Area Transit Authority, or the General Manager's designee;</text>
</para>
<para>
<num>(8)</num>
<text>The Director of the Alcoholic Beverage Regulation Administration, or the Director's designee; and</text>
</para>
<para>
<num>(9)</num>
<text>Nine community representatives, appointed by the Mayor pursuant to <code-cite doc="D.C. Code" path="§1-523.01|(f)">section 2(f) of the Confirmation Act of 1978, effective March 3, 1979 (D.C. Law 2-142; D.C. Official Code § 1-523.01(f))</code-cite>, who are District residents or members of organizations that engage in policy, advocacy, or direct service within the District related to:</text>
<para>
<num>(A)</num>
<text>Street harassment;</text>
</para>
<para>
<num>(B)</num>
<text>Gender-based violence;</text>
</para>
<para>
<num>(C)</num>
<text>Gender equity;</text>
</para>
<para>
<num>(D)</num>
<text>LGBTQ rights;</text>
</para>
<para>
<num>(E)</num>
<text>Racial equity;</text>
</para>
<para>
<num>(F)</num>
<text>Religious tolerance;</text>
</para>
<para>
<num>(G)</num>
<text>Poverty or homelessness; or</text>
</para>
<para>
<num>(H)</num>
<text>Immigrant rights.</text>
</para>
</para>
</para>
<para>
<num>(b)</num>
<text>The Director of OHR, or the Director's designee, shall serve as the ACSH's chairperson.</text>
</para>
<para>
<num>(c)</num>
<text>One community representative shall be selected by a majority vote of the community representatives of the ACSH to serve as vice-chairperson.</text>
</para>
<para>
<num>(d)</num>
<text>The ACSH shall meet at least on a quarterly basis, at times to be determined by the chairperson at the ACSH's first meeting.</text>
</para>
<para>
<num>(e)</num>
<text>Meetings of the ACSH shall be subject to <code-cite doc="D.C. Code" path="2|5|IV">the Open Meetings Act, effective March 31, 2011 (D.C. Law 18-350; D.C. Official Code § 2-571 <em>et seq.</em>)</code-cite>.</text>

<text>No later than September 30, 2019, the ACSH shall submit a report to the Mayor and Council that:</text>

<num>(1)</num>
<text>Identifies categories of District employees and District residents most at risk of street harassment;</text>
</para>
<para>
<num>(2)</num>
<text>Proposes model policies and training materials to be adopted by District agencies for preventing and responding to street harassment, including model policies and training materials for public-facing employees;</text>
</para>
<para>
<num>(3)</num>
<text>Proposes strategies to improve public awareness and understanding of street harassment;</text>
</para>
<para>
<num>(4)</num>
<text>Discusses the need, if any, for a process by which victims and witnesses of street harassment can report instances of street harassment to District agencies; and</text>
</para>
<para>
<num>(5)</num>
<text>Summarizes any actions taken by the ACSH after <span codify:value="October 30, 2018">the effective date of this subtitle</span>.</text>
</para>
</para>
<para>
<num>(b)</num>
<text>No later than April 1, 2020, all District agencies shall:</text>
<para>
<num>(1)</num>
<text>Implement the model policies developed pursuant to subsection (a) of this section; and</text>
</para>
<para>
<num>(2)</num>
<text>Integrate training materials developed pursuant to subsection (a) of this section into the training of District employees.</text>
</para>
</para>
<para>
<num>(c)</num>
<text>OHR shall:</text>
<para>
<num>(1)</num>
<text>Monitor District agencies' implementation of the model policies developed pursuant to subsection (a) of this section; and</text>
</para>
<para>
<num>(2)</num>
<text>No later than September 30, 2019, conduct a public information campaign about street harassment and resources available in the District for victims of street harassment.</text>

<text>The use of the school building does not impose a cost on the District, except for the costs of custodial and security services; and</text>

<text>A civic association shall not enter into a use agreement to use a District of Columbia Public Schools school building for more than 12 regularly scheduled meetings in a calendar year.</text>

<num>(b)</num>
<text>The Department of General Services shall reimburse a civic association for the costs of obtaining the liability insurance required under its use agreement if that insurance is purchased through a District-approved insurance partnership program.</text>

<text>For the purposes of this section, the term "civic association" means:</text>
<para>
<num>(1)</num>
<text>A nonprofit association, corporation, or other organization that is:</text>
<para>
<num>(A)</num>
<text>Comprised primarily of residents of the community within which the school to be used is located;</text>
</para>
<para>
<num>(B)</num>
<text>Operated for the promotion of social welfare and general neighborhood improvement and enhancement; and</text>
</para>

<num>(C)</num>
<text>Exempt from taxation under section 501(c)(3) or (4) of the Internal Revenue Code of 1986, approved August 16, 1954 (68A Stat. 163; 26 U.S.C. § 501(c)(3), (4)), or a member of the D.C. Federation of Civic Associations or the Federation of Citizens Associations of the District of Columbia; or</text>

<text>There is established the Neighborhood Prosperity Initiative ("Initiative"), which shall be administered by the Mayor and under which the Mayor may provide, on a competitive basis, grants for commercial, non-residential components of a qualifying project to applicants that:</text>

<num>(1)</num>
<text>Propose a qualifying project;</text>
</para>
<para>
<num>(2)</num>
<text>Have a deficit in funding for a commercial, non-residential component of the qualifying project;</text>
</para>
<para>
<num>(3)</num>
<text>Agree to commence construction on the qualifying project within 18 months of the award of an Initiative grant, or within such other time period as may be established by the Mayor;</text>
</para>
<para>
<num>(4)</num>
<text>Agree to enter into a First Source agreement, if applicable, and a Certified Business Enterprise agreement; and</text>
</para>
<para>
<num>(5)</num>
<text>Agree to use a grant provided under the Initiative only for the commercial, non-residential components of the project for which the grant is provided.</text>
</para>

<num>(b)</num>
<text>For the purposes of this subtitle, the term:</text>

<text>"Certified Business Enterprise agreement" means an agreement with the Department of Small and Local Business Development pursuant to <code-cite doc="D.C. Official Code § 2-218.01 <em>et seq.</em>)</code-cite>.</text>

<text>"First Source agreement" means an agreement with the Department of Employment Services governing certain obligations of the developer pursuant to <code-cite doc="D.C. Code" path="§2-219.03">section 4 of the First Source Employment Agreement Act of 1984, effective June 29, 1984 (D.C. Law 5-93; D.C. Official Code § 2-219.03),</code-cite> and Mayor's Order 83-265, dated November 9, 1983, regarding job creation and employment generated as a result of the construction on the property.</text>

<heading>Short title.</heading>
<text>This subtitle may be cited as the "Arts and Humanities License Plates Amendment Act of 2018".</text>

<text>Title IV of the District of Columbia Revenue Act of 1937, approved August 17, 1937 (50 Stat. 679; D.C. Official Code § 50-1501.01 <em>et seq.</em>), is amended as follows:</text>

<num>(a)</num>
<text>A new section 2e is added to read as follows:</text>

<heading>Issuance of arts and humanities motor-vehicle identification tags.</heading>
<para>
<num>(a)</num>
<text>The Mayor may make available for issue one or more arts and humanities motor-vehicle identification tags to enhance the public's awareness of the District's arts and humanities communities, works, and programming. At the request of the Mayor, the Commission on Arts and Humanities ("Commission") shall provide to the Mayor proposed designs of the arts and humanities motor-vehicle identification tags, which the Commission may solicit from District residents.</text>
</para>
<para>
<num>(b)</num>
<text>A resident ordering an arts and humanities motor-vehicle identification tag designed and issued pursuant to subsection (a) of this section shall pay a one-time application fee and a display fee each year thereafter, in amounts to be determined by the Mayor by rule.</text>
</para>
<para>
<num>(c)</num>
<text>Application fees and annual display fees collected pursuant to subsection (b) of this section shall be deposited into the Arts and Humanities Enterprise Fund, established by <code-cite doc="D.C. Code" path="§39-205.01">section 6a of the Commission on the Arts and Humanities Act, effective January 29, 1998 (D.C. Law 12-42; D.C. Official Code § 39-205.01)</code-cite>.</text>

<text>For the purposes of this subsection, the term "eligible household" means a household determined by the Authority to be eligible to participate in the Authority's Housing Choice Voucher Program.</text>

<text>The application fees imposed by section 2112 for elevator contractors, elevator mechanics, elevator inspectors, and tour guides shall apply beginning May 1, 2004. The collection of all such fees during the period from May 1, 2004, to the effective date of this act is ratified. Any such fees imposed for that period not already collected as of the effective date of this act shall be waived.</text>

<num>(b)</num>
<text>The application and license fee imposed by section 2112 for body artists shall apply beginning October 1, 2012.
