homebrew fails to install on clean macOS Sierra 10.12.1 #1726

when doing a normal homebrew install with:

ruby -e "$(curl -fsSL https://raw.githubusercontent.com/Homebrew/install/master/install)" </dev/null

it fails to install with:

==> /usr/bin/sudo /usr/sbin/chown vagrant /Library/Caches/Homebrew
==> Searching online for the Command Line Tools
==> /usr/bin/sudo /usr/bin/touch /tmp/.com.apple.dt.CommandLineTools.installondemand.in-progress
Couldn’t communicate with a helper application.
==> Installing
==> /usr/bin/sudo /usr/sbin/softwareupdate -i
: No such update
No updates are available.

Copyright 2002-2015 Apple Inc.
==> /usr/bin/sudo /bin/rm -f /tmp/.com.apple.dt.CommandLineTools.installondemand.in-progress
==> /usr/bin/sudo /usr/bin/xcode-select --switch /Library/Developer/CommandLineTools
xcode-select: error: invalid developer directory '/Library/Developer/CommandLineTools'

for some reason it failed to get the Xcode command line tools from the Apple Store. Any idea how to fix this?

oh, retrying the install until it works does the trick:

while ! ruby -e "$(curl -fsSL https://raw.githubusercontent.com/Homebrew/install/master/install)" </dev/null; do
    sleep 5
    echo 'retrying homebrew install...'
