...only when it's intended, like voluntarily attack a friendly unit ?
Because guess what : nukes, support powers like parabombs, uncontrolable submarines torpedoes etc.

It's not always easy to detect if an action was voluntary or not. If you are dropping a nuke near allied units then you risk killing them deliberately, hence I think a penalty if you kill them would not be inappropriate.
