"we can't really punish people for being the first to encounter a bug" <-- is this true if the card is also marked as a bug -- think about it and agree a rule #1537

If it is a known bug, then they are not the first to encounter it.

If the card has a bug other than the one encountered, (Scythe of the Wretched), or the bug has changed the way it occurs (see the mess with PennyDreadfulMTG/modo-bugs#50 for example), it's a new bug, and should be treated accordingly.
