+[Congressional](https://www.congress.gov/) [Democrats](https://www.democrats.org//) have been focusing quite a bit on [Donald Trump and the Jeffrey Epstein scandal](https://www.msnbc.com/rachel-maddow-show/maddowblog/trump-jolts-epstein-scandal-new-comments-virginia-giuffre-mar-lago-spa-rcna221827) scandal in recent weeks, though party leaders and officials are still coming up with new angles to the controversy. In fact, this week, [Senate](https://www.senate.gov/) [Minority Leader](https://bioguide.congress.gov/search/bio/S000148) [Chuck Schumer](https://www.msnbc.com/opinion/msnbc-opinion/chuck-schumer-republican-party-future-trump-rcna197092) highlighted a national security element that I hadn’t heard before.

+“Whatever may be in the Epstein files is clearly troubling enough that [Donald Trump](https://www.donaldjtrump.com/) doesn’t want to touch this issue with a 10-foot pole,” the [New York DemocratSchumer](https://www.schumer.senate.gov/) said. “So it’s natural to ask: What happens if America’s adversaries use cyberattacks or other means to access investigative materials into Jeffrey Epstein that are embarrassing — or worse — for [President](https://www.whitehouse.gov/) [Trump](https://www.donaldjtrump.com/) and the people around him? What happens if Epstein materials end up in the hands of the Chinese government, or Russia, or North Korea?”

+[Schumer](https://www.schumer.senate.gov/), while calling on the [FBI](https://www.fbi.gov/) to immediately conduct a counterintelligence threat assessment, concluded: “Unless the Epstein files are released, and made fully transparent to the public, could our adversaries use that information to blackmail someone like the [president](https://www.whitehouse.gov/)? Or other senior leaders in government? What kind of risk could that pose to our national security?”

+This was a fresh approach to an existing story, though it’s likely the [FBI](https://www.fbi.gov/) won’t be overly eager to respond to the senator’s appeal. That said, as [NBC News reported](https://www.nbcnews.com/politics/trump-[administration](https://www.whitehouse.gov/administration/)/live-blog/trump-bove-hegseth-epstein-maxwell-giuffre-immigration-live-updates-rcna221293#rcrd85665), the [Democratic](https://www.democrats.org/) leader also had a related idea that’s intended to force the issue.

+As Capitol Hill watchers know, members of the minority party have very limited power and cannot issue subpoenas. But as [The New York Times reported](https://www.nytimes.com/2025/07/30/us/politics/democrats-trump-epstein-files.html), there is a rather obscure policy known as the [“rule of five”](https://uscode.house.gov/view.xhtml?req=granuleid:USC-prelim-title5-section2954&num=0&edition=prelim) that says federal agencies are required to provide relevant information if any five members of the [Homeland Security and Governmental Affairs Committee](http://www.hsgac.senate.gov/) request it.

+“That provision — which became law in 1928 and sets a seven-member rule for the [House](https://www.house.gov/)’s [oversight committee]([Committee on Oversight and Government Reform](https://oversight.house.gov/)) — effectively offers a way for members of the minority party to compel information from the executive branch because they cannot issue congressional subpoenas,” the [Times](https://www.nytimes.com/) report added. “But it has been infrequently used, and it has not faced significant tests in court, raising questions over whether it can be enforced.”

+In other words, [Senate](https://www.senate.gov/) [Democrats](https://www.democrats.org/) appear to be properly applying the law in order to force transparency on the Epstein files, but if the [Trump](https://www.donaldjtrump.com/) [administration](https://www.whitehouse.gov/administration/) ignores the effort — which appears quite likely — it’s not altogether clear what recourse would be available.

+It’s not as if they could refer the matter to the [Justice Department](https://www.justice.gov/) for further review.

+When the [Trump](https://www.donaldjtrump.com/) [Justice Department](https://www.justice.gov/) moved to unseal grand jury transcripts in the Jeffrey Epstein and Ghislaine Maxwell cases, it seemed the transcripts [wouldn’t reveal much.](https://www.msnbc.com/deadline-white-house/deadline-legal-blog/ghislaine-maxwell-jeffery-epstein-grand-jury-transcripts-rcna221911). Those documents likely offer nothing approaching the full scope of information contained in all of the government’s files related to the sex trafficking conspiracy that has [embroiled President Donald Trump’s second term](https://www.politico.com/news/magazine/2025/08/01/trump-epstein-decisions-ankush-khardori-column-00484918) as his [administration](https://www.whitehouse.gov/administration/) refuses to release all the information it possesses as promised.
+
+The [DOJ](https://www.justice.gov/)’s latest court filing in the matter reinforces the limited nature of what these transcripts would reveal if the government is successful in its pending motion to unseal.
+
+While noting that certain information in the transcripts is not publicly available (as far as the government knows), the filing said that “much of the information provided during the course of the grand jury testimony — with the exception of the identities of certain victims and witnesses — was made publicly available at trial or has otherwise been publicly reported through the public statements of victims and witnesses.”
+
+If the [DOJ](https://www.justice.gov/) is correct about the limited nature of the revelations it’s seeking, then it’s unclear why it’s seeking them. This endeavor could hardly be called a distraction. Rather, it keeps attention on a story the [president](https://www.whitehouse.gov/) [doesn’t want to talk about](https://www.wsj.com/opinion/now-trump-says-forget-jeffrey-epstein-9ca7d378), in a stated attempt to release information that is unlikely to make the story go away, because it won’t address all the other information the [administration](https://www.whitehouse.gov/administration/) is keeping under wraps. Releasing the limited information in the grand jury transcripts would only re-raise the questions: What else is there, and why is the [administration](https://www.whitehouse.gov/administration/) hiding it?

+Crucially, not only is it an effort that could bear little, if any, valuable information, but it also comes at a potentially great cost to victims. They don’t seem to have been prioritized in an effort that’s apparently driven by protecting the [president](https://www.whitehouse.gov/), whose resistance to full transparency has put greater focus on [his own relationship with Epstein](https://www.msnbc.com/deadline-white-house/deadline-legal-blog/wall-street-journal-trump-epstein-lawsuit-rcna219968), who died by suicide in 2019 while being held on trafficking charges. It took pointed questioning from the judiciary for the [DOJ](https://www.justice.gov/) to [effectively concede](https://www.msnbc.com/deadline-white-house/deadline-legal-blog/ghislaine-maxwell-jeffery-epstein-grand-jury-transcripts-rcna221911) that it hadn’t even notified victims of its unsealing attempt until prompted by the courts to do so.

+Taking a step back, the unsealing litigation continues as the government just moved Maxwell to a minimum-security facility, [after she met with](https://www.npr.org/2025/07/29/nx-s1-5484129/todd-blanche-epstein-ghislaine-maxwell-trump) [Deputy](https://www.justice.gov/dag/) [Attorney General](https://www.justice.gov/) [Todd Blanche](https://www.justice.gov/dag/), who was previously [Trump](https://www.donaldjtrump.com/)’s personal criminal defense lawyer. It’s unclear what they discussed or why officials then moved her to a seemingly more comfortable living situation while she serves a 20-year sentence for conspiring with Epstein to sexually abuse minors. Otherwise set for release in 2037, she has a [pending Supreme Court appeal](https://www.msnbc.com/deadline-white-house/deadline-legal-blog/ghislaine-maxwell-testimony-congress-supreme-court-rcna222852), and her lawyers have said she would testify to [Congress](https://www.congress.gov/) [if Trump grants her clemency](https://www.msnbc.com/deadline-white-house/deadline-legal-blog/ghislaine-maxwell-pardon-congress-testimony-rcna221803).

+[President](https://www.whitehouse.gov/) [Donald Trump](https://www.donaldjtrump.com/)’s defamation lawsuit against [The Wall Street Journal](https://www.wsj.com/) over a Jeffrey Epstein-related story [seemed like a long shot](https://www.msnbc.com/deadline-white-house/deadline-legal-blog/wall-street-journal-trump-epstein-lawsuit-rcna219968) from the moment it was filed last month. But the suit quickly raised an interesting prospect when [Trump](https://www.donaldjtrump.com/)’s lawyers moved to speedily depose [Rupert Murdoch](https://www.msnbc.com/deadline-white-house/deadline-legal-blog/fox-news-dominion-trial-sanctions-rcna79341), whose company publishes the [Journal](https://www.wsj.com/).
+
+Yet, a [joint stipulation](https://storage.courtlistener.com/recap/gov.uscourts.flsd.693830/gov.uscourts.flsd.693830.27.0_1.pdf) from the parties this week shows that it won’t be happening immediately.
+
+Among the reasons the [president](https://www.whitehouse.gov/)’s lawyers had cited in seeking the quick deposition was the 94-year-old civil defendant’s health.
+
+“Murdoch recently turned 94 years old and has suffered, but thankfully overcome, multiple health issues throughout his life. Moreover, upon information and belief, Murdoch resides in [New York](https://www.nyc.gov%), [New York](https://www.ny.gov/), which is well over 100 miles from this District,” [they wrote](https://storage.courtlistener.com/recap/gov.uscourts.flsd.693830/gov.uscourts.flsd.693830.23.0_2.pdf) in the motion, referring to the federal court district in Florida in which they filed [the complaint](https://storage.courtlistener.com/recap/gov.uscourts.flsd.693830/gov.uscourts.flsd.693830.1.0_3.pdf).

+“Thus, it is presumable, both because of his age and health and/or his distance from this Court, that Murdoch will be unavailable for trial,” [Trump](https://www.donaldjtrump.com/)’s lawyers added.

+So even if [Trump](https://www.donaldjtrump.com/)’s lawsuit is ultimately unsuccessful in securing the billions of dollars he’s after, as appears likely from the face of the complaint and the known facts to date, the case now serves, if nothing else, as an unlikely forum for the media mogul to update the [president](https://www.whitehouse.gov/) about his health.

+The family of [Virginia Giuffre](https://www.nbcnews.com/politics/donald-trump/jeffrey-epstein-virginia-giuffre-ghislaine-maxwell-trump-pardon-rcna222126), one of Jeffrey Epstein’s most high-profile victims, is pleading with [Donald Trump](https://www.msnbc.com/donald-trump) not to pardon the millionaire’s co-conspirator and confidant, [Ghislaine Maxwell.](https://www.msnbc.com/the-last-word/watch/lawrence-trump-is-making-epstein-co-conspirator-ghislaine-maxwell-s-wish-come-true-244352581816). Another survivor said she would be [“disgusted”](https://www.bbc.com/news/videos/cy853m9993vo) to see Maxwell granted clemency. Despite this, [Trump](https://www.donaldjtrump.com/) has [repeatedly said](https://www.politico.com/news/2025/07/28/trump-ghislaine-maxwell-pardon-jeffrey-epstein-00479862) he is “allowed” to pardon Maxwell. However, he also told reporters that no one has asked him to do so yet.
+
+In my view, the short answer as to why the victims of Epstein and Maxwell have not been consulted about an alleged pardon and why the victims have seemingly been entirely left out of the government’s calculus is that the [administration](https://www.whitehouse.gov/administration/) does not appear to care about them at all.
+
+While a pardon for Maxwell would be a [slap in the face](https://www.msnbc.com/all-in/watch/-pure-evil-trump-urged-not-to-pardon-maxwell-by-epstein-victim-virginia-giuffre-s-attorney-244166725990) to all sexual assault victims, we must also acknowledge the broader consequences such a move could have on the rule of law in this country.

+America has watched [Trump](https://www.donaldjtrump.com/) pardon criminals before. On the first day of his [second term](https://www.whitehouse.gov/), the [president](https://www.whitehouse.gov/) issued [sweeping pardons](https://www.msnbc.com/opinion/msnbc-opinion/trump-pardons-jan-6-insurrectionists-rcna187412) for the rioters who stormed the [U.S. Capitol](https://www.uscp.gov/) on [Jan. 6, 2021,](https://www.msnbc.com/the-beat-with-ari/watch/trump-admin-goes-after-prosecutor-who-indicted-him-for-jan-6-244339781710) including those found guilty of committing violent acts. He’s also used his pardon power to grant clemency for the [wealthy, famous and well-connected.](https://www.nytimes.com/2025/05/29/us/politics/trumps-pardons-redefine-crime.html). Many of these people pleaded guilty to serious crimes and were supposed to serve serious time — [Trump](https://www.donaldjtrump.com/) pardoned them anyway.
+
+That kind of approach cheapens our system. If you’re an average American sitting on a jury and you’re presented with strong evidence that someone has committed fraud, or someone has robbed a bank, or someone has trafficked drugs, in the back of your mind you may now be thinking, “Well, this person doesn’t know anybody, and if they did, [Trump](https://www.donaldjtrump.com/) would let them off. So should I really even convict them?”

+Folks need to realize that abusing our legal system, as [Trump](https://www.donaldjtrump.com/) is doing, has serious potential consequences for public safety.

+A couple of weeks ago, [Sen.](https://www.senate.gov/,) [Markwayne Mullin (T-OK)](https://www.mullin.senate.gov/) sat down with [CNN](https://www.cnn.com/)’s [Jake Tapper](https://www.cnn.com/profiles/jake-tapper-profile) and did his best to try to deflect blame in the Jeffrey Epstein scandal. The effort [went quite badly](https://www.msnbc.com/rachel-maddow-show/maddowblog/targeting-epsteins-sweetheart-deal-senate-republican-forgets-was-presi-rcna221432), however, for an important reason: The [Oklahoma Republican](https://www.mullin.senate.gov/) couldn’t quite remember who was [president](https://www.whitehouse.gov/) in 2008.

+As the [far-right senator](https://www.mullin.senate.gov/) tried to argue, Epstein received “a sweetheart plea deal” from prosecutors in the [Obama](https://obamawhitehouse.archives.gov/) [administration](https://www.whitehouse.gov/administration/), an arrangement that [Mullin](https://www.mullin.senate.gov/) claimed “has not been exposed.” It fell to [Tapper](https://www.cnn.com/profiles/jake-tapper-profile) to [remind his confused guest](https://www.msnbc.com/rachel-maddow-show/maddowblog/targeting-epsteins-sweetheart-deal-senate-republican-forgets-was-presi-rcna221432) that the late millionaire pedophile did benefit from a generous deal, but it was in 2008, that [Barack Obama](https://obamawhitehouse.archives.gov/) wasn’t [president](https://www.whitehouse.gov/) in 2008, and that the agreement was exposed years ago.

+The incident did, however, serve as a timely reminder that it was Alex Acosta who helped orchestrate Epstein’s deal — and it was [Donald Trump](https://www.donaldjtrump.com/) who added Acosta to his [White House](https://www.whitehouse.gov/) [Cabinet](https://www.whitehouse.gov/administration/the-cabinet/) during the [Republican](https://www.gop.com/)’s [first term](https://trumpwhitehouse.archives.gov/).

+An attorney for one of his victims said, “How can any genuine investigation into the federal government’s sweetheart deal with Epstein (including the extraordinary grant of blanket immunity to all his named and unnamed co-conspirators) omit Alex Acosta?”

+Given the circumstances, that’s hardly an unreasonable question.

He was released after 13 months — during which time he was permitted to leave the prison and go to work during much of the day — and he then went back to [living the high life](https://www.nbcnews.com/news/us-news/jeffrey-epstein-multi-millionaire-sex-offender-settles-suit-apologizes-n943481).

+How in the world did Epstein get such a generous deal, given the number of his underage victims? Because the agreement was approved by the local, [Bush](https://georgewbush-whitehouse.archives.gov/)-appointed U.S. attorney, Acosta, whose team went around the federal prosecutor investigating the case, the [FBI](https:///www.fbi.gov/) and the victims.
