Content refers to content such as text, images, or other information that can be posted, uploaded, linked to or otherwise made available by You, regardless of the form of that content.

Subscription refers to paid access to premium features of the Service.

You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.
These are the Terms and Conditions governing the use of this Service and the agreement that operates between You and the Company.
By accessing or using the Service You agree to be bound by these Terms and Conditions. If You disagree with any part of these Terms and Conditions then You may not access the Service.
You represent that you are over the age of 13. The Company does not permit those under 13 to use the Service.
Your access to and use of the Service is also conditioned on Your acceptance of and compliance with the Privacy Policy of the Company. Please read Our Privacy Policy carefully before using Our Service.
Some parts of the Service are available only with a paid Subscription. You will be billed in advance on a recurring basis depending on the plan you select. Your Subscription will automatically renew unless You cancel it or the Company cancels it.
You may cancel Your Subscription renewal through Your Account settings or by contacting the Company. You will not receive a refund for fees already paid and will retain access until the end of Your current billing period.
If the Subscription was made through an app store (Apple App Store or Google Play Store), You can cancel through that store.
The Company may modify Subscription fees at any time. Changes take effect at the end of Your current billing period. We will provide reasonable prior notice of any fee change.
Except when required by law, paid Subscription fees are non-refundable. Refund requests may be considered on a case-by-case basis at the sole discretion of the Company.
For Subscriptions made through an app store, that store's refund policy applies. Contact the store directly for refund requests.
The Service may include in-app purchases. In-app purchases can only be used within the Service and cannot be redeemed for cash or transferred. All billing for in-app purchases made through an app store is handled by and governed by that store's terms. Contact the store directly for any payment issues.
When You create an account with Us, You must provide accurate and current information. You are responsible for safeguarding Your password and for any activity under Your account.
You agree not to disclose Your password to any third party and to notify Us immediately of any unauthorized use of Your account.
You may not use as a username the name of another person or entity with intent to defraud or impersonate that person or entity. Parody accounts should be clearly marked as such in usernames.
Our Service allows You to post Content. You are responsible for the Content that You post, including its legality, reliability, and appropriateness.
By posting Content to the Service, You grant Us the right and license to transmit, publicly display, reproduce, and distribute such Content on and through the Service. You retain all of Your rights to any Content You submit, post or display on or through the Service. This license exists solely to allow Us to deliver Your Content to other users.
By posting Content to the Service, You agree to the Platform Rules.
You represent and warrant that: (i) the Content is Yours or You have the right to use it and grant Us the rights and license as provided in these Terms, and (ii) the posting of Your Content does not violate the privacy rights, publicity rights, copyrights, contract rights or any other rights of any person.
You are solely responsible for all Content and activity under Your account. You may not transmit any Content that breaches Our Platform Rules. Examples of prohibited Content include, but are not limited to:
- Unlawful content or promoting unlawful activity
- Defamatory content or targeted harassment
- Spam or unsolicited advertising
- Viruses, malware, or other harmful software
- Content infringing on intellectual property rights
- Impersonating any person or entity
- Violating the privacy of any third person
The Company reserves the right to remove Content or limit Your access to the Service if You post prohibited Content. The Company does not pre-screen all user content and is not liable for any content posted by users. The Company endeavors to review reported content in a reasonable timeframe and take appropriate action, but is not obligated to do so.
We perform regular backups but do not guarantee against data loss or corruption. The Company has no liability related to the integrity of Content or the failure to restore Content. You agree to maintain a complete and accurate copy of any Content in a location independent of the Service.
We respect intellectual property rights. If You believe Content on the Service infringes Your copyright, submit a DMCA notice to dmca@valour.gg with:
- A signature of the copyright owner or authorized representative
- A description of the copyrighted work and where the infringing material is located on the Service
- Your contact information
- A good faith statement that the use is not authorized
- A statement under penalty of perjury that Your notice is accurate
Upon receipt, the Company will take appropriate action, which may include removal of the content.
You may be held accountable for damages for misrepresenting that Content infringes Your copyright.
The Valour source code is licensed under the GNU Affero General Public
License v3 (AGPL-3.0). The name "Valour" and associated branding are
trademarks of Valour Software LLC. Forks or derivative projects may not
use the Valour name or branding without prior written permission. See the
LICENSE file for full details. User-generated Content is not covered by
the AGPL-3.0 license and remains subject to these Terms.
The Service may contain links to third-party websites or services not owned or controlled by the Company. We are not responsible for the content or practices of any third-party sites.
We may terminate or suspend Your Account immediately, without prior notice or liability, for any reason, including if You breach these Terms. Upon termination, Your right to use the Service ceases immediately.
You have a right to appeal termination by contacting the Company. We will review appeals on a case-by-case basis using human reviewers.
The Company's total liability under these Terms is limited to the amount You have paid through the Service or 100 USD, whichever is greater.
To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, special, or consequential damages, including loss of profits, data, or privacy, even if advised of the possibility of such damages.
Some states do not allow these limitations, in which case liability will be limited to the greatest extent permitted by law.
The Service is provided "AS IS" and "AS AVAILABLE" without warranty of any kind. The Company disclaims all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.
Some jurisdictions do not allow these exclusions, in which case they shall apply to the greatest extent enforceable under applicable law.
The laws of the State of Wyoming, excluding its conflict of law rules, shall govern these Terms. Your use of the Service may also be subject to other local, state, national, or international laws.
If You have any concern or dispute about the Service, You agree to first try to resolve the dispute informally by contacting the Company.
You represent and warrant that (i) You are not located in a country that is subject to a United States government embargo, or that has been designated by the United States government as a "terrorist supporting" country, and (ii) You are not listed on any United States government list of prohibited or restricted parties.
If You are a European Union consumer, You will benefit from any mandatory provisions of the law of the country in which You are resident.
If any provision of these Terms is held to be unenforceable or invalid, it will be interpreted to accomplish its objectives to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
The failure to exercise a right under these Terms does not waive that right.
We reserve the right to modify or replace these Terms at any time. For material changes, We will make reasonable efforts to provide at least 30 days' notice. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
