Intellectual Property Policy
The WKU Makerspace is a campus-wide innovation space within which WKU faculty, staff, and students are encouraged to collaborate, learn, and explore. Use of the WKU Makerspace does not create any intellectual property (“IP”) obligations for the user; no new obligations are added by use of the WKU Makerspace facility; the use of the facility, equipment, supplies, or staff support will not create any obligation for WKU employees and/or students to report inventions or assign said inventions to the University.
All WKU Makerspace users have the right to create constitutionally protected content, so long as it does not violate the rights of others. The WKU Makerspace respects individual IP rights and all users have the right to maintain the integrity of the content they have created and to be acknowledged as the creator of their content.
Use of the WKU Makerspace does not affect any pre-existing IP obligations that may apply to what a user brings into or creates in the WKU Makerspace. IP obligations cannot be eliminated or created simply by use of the WKU Makerspace facility. Users of the WKU Makerspaces agree to not infringe upon any third-party’s copyright, patent, trademark trade secret or other proprietary or intellectual property rights in their use of the facility.
The only obligation that is created by use of the facility is to abide by all policies and to help provide a continuing safe and secure environment for design, fabrication, collaboration and learning activities. WKU Makerspace users are expected to respect the rights of others, the integrity of the makerspace resources, and the community mission of the makerspace. Part of the preservation of a safe and secure environment requires that the rights and privileges, as well as the incentive, of makers (inventors, authors, creators) be preserved so that makers may be further encouraged and stimulated.
