Yes, I believe Directgov is wrong. Here's the Act: http://www.legislation.gov.uk/ukpga/1971/80/schedule/1 :

New Year’s Day, if it be not a Sunday or, if it be a Sunday, 3rd January.
2nd January, if it be not a Sunday or, if it be a Sunday, 3rd January.

This seems pretty clear (though in previous years it's far worse, and I'm a bit worried that the New Year's Day holiday in 2011 in Scotland didn't happen when everyone thought it did... :) ).

I have today had confirmation from the Scottish Government that 4th January 2010 and 2011 were not designated as Bank Holidays by Royal Proclamation.
