I was -as usual- minding my own BeesWax when a mail popped in for the <a href=redirect.php3?op=redir&sid=24&url=http%3A%2F%2Fcommercial-archive.com>commercial-archive</A> It began with the Subject "a word of caution" which aroused my curiosity and continued: <B>I assume that you have clearances from SAG and AFTRA where applicable for the commercials you are showing on your site.</B> <br><br><B>...."I am not an actor, and I am not against entertainment, I am not even
against commercials as entertainment, but I'm sure you are aware that
there is a bitter strike going on by the above mentioned guilds against
the advertising industry (and a well-justified strike in my opinion).

I hope that my reservations about your website are unwarranted, but I
will be forwarding your webpages to people at the guild for review,
nonetheless.

Thought I'd let you know."</B><P> I suddenly felt as if I was farming Minks or puppies for animal testing and fur rather than running a site as a hobby (for free!).<BR> <BR> It made me wonder, what would actually happen if the SAG and AFTRA decided to take action against my site?<BR> It's not the could they, it's the "should they" I'm thinking about.<BR> If the online world gets any more commercial, you will have to kiss non-profit hobbyists like me goodbye and say hello to sites such as <a href=redirect.php3?op=redir&sid=24&url=http%3A%2F%2Fwww.adforum.com>adforum.com</A> instead. <BR>Nothing wrong with that except you have lost your right to choose between commercial and non commercial sites with content that you are interested in. A privately run site can not afford to keep track of all legal entaglements in the same fashion as a commercial one can, naturally. Neither should we have to.<BR> An interesting thing to note in this context is the fact that SAG and AFTRA are american organisations, and my site is run by me (Swedish citizen) from Amsterdam and the machine the site is hosted on is in Amsterdam as well.<BR> I would be extremely interested in any outcome of <I>any</I> actors guild taking it up with any site showcasing commercials- in or out of court- and I would definatly be interested in the outcome of them asking <B>me</B> to remove any commercials from my site. <BR> How could they when nothing ties the site to the US apart from the .com? From a legal point of view this could get dizzying. The world wide web lies within countries real borders, still, and thus should follow the laws where the machine is.<BR> This has not always been the case before though. See <a href=redirect.php3?op=redir&sid=24&url=http%3A%2F%2Fwww.yomiuri.co.jp%2Fnewse%2F0815cu25.htm> the story about the Gajin a Go-Go site</A> who in the end removed a japanese ad featuring Arnold Schwarzenegger after pressure from DirectTV's and Dentsu's lawyers.</TD>

Actors don''t care if you are using their likeliness, and neither does their agents. Otherwise, it would be much more difficult to find a picture of an actress with the works Sucks big **** next to it. Or, for that matter, non-profit fan sites would be a thing of the past. They care about dollars. If they see their image somewhere they look to make a profit. This is exactly what is happening in this case, and others like it. I agree that actors should get paid for their work, but not by people who make no profit off of using their images. If actors were actually concerned about the fair use of their images, then they shouldn''t aspire to be actors in the first place. So I say, Keep it up. Damn bueracracy and their money making schemes. <br>
