DevJet Software DocInsight End User License Agreement (EULA)

This End User License Agreement ("EULA") is a legal agreement between you, either an individual or an entity (hereinafter referred to as the "Licensee"), and DevJet Software ("DevJet") regarding the use of the software product "DocInsight" (the "Product"), also known as "Documentation Insight."
By installing or using this Product, you agree to the terms of this EULA. If you do not agree, do not use the Product.
- "Product" refers to the software application "DocInsight" provided by DevJet Software.
- "DevJet Software" refers to the proprietor operating as a sole proprietorship under the business name DevJet Software.
- "Licensee" refers to the individual or entity agreeing to this EULA.
- "Subscription" refers to the annual subscription model under which the Product is offered.
- "Documentation Output" refers to any documentation generated using the Product.
DevJet Software grants the Licensee a non-exclusive, non-transferable license to use the Product in accordance with the terms outlined in this EULA. All rights, title, and interest in and to the Product, including all intellectual property rights, are and will remain the exclusive property of DevJet Software.
3.1. Commercial License
3.1.1. The Commercial License is purchased by a business organization and assigned to individual developers within that organization.
3.1.2. Each developer using the Product must have an individual license; licenses may not be shared or used concurrently by multiple developers.
3.1.3. Licenses are owned and controlled by the purchasing organization.
3.2. Personal License
3.2.1. The Personal License is designed for individual developers. It must be purchased using personal funds and not through company finances.
3.2.2. The Personal License is non-transferable and cannot be resold, rented, or otherwise redistributed.
3.3. Trial License
3.3.1. The Trial License is provided for evaluation purposes only.
3.3.2. The Trial License allows access to limited features during the trial period. After the trial period expires, access to certain features may be restricted.
3.3.3. Redistribution of Documentation Output generated during the trial period is strictly prohibited.
4.1. Annual Subscription The Product is offered on an annual subscription basis.
4.2. Pricing The initial registration price and yearly renewal price are subject to change. Current pricing details are available on DevJet Software's official website. By subscribing, you agree to the pricing terms applicable at the time of your subscription and any subsequent renewals.
4.3. Money Back Guarantee DevJet Software offers a 30-Day Money Back Guarantee. If you are not satisfied with the Product, you may request a full refund within 30 days of your initial purchase, provided you have not exceeded the usage terms outlined in this EULA.
4.4. Renewal Options Customers may choose between manual renewal and automatic renewal for their subscriptions:

Manual Renewal: The Licensee must manually renew the subscription before it expires to continue using the Product without interruption.

Automatic Renewal: The subscription will automatically renew at the end of each annual term unless the Licensee cancels the auto-renewal option.
4.5. Cancellation The Licensee may cancel the subscription at any time. Upon cancellation, the Licensee is entitled to use only the versions of the Product released during the subscription period. Access to future updates, features, and support will cease upon cancellation.
5.1. Installation
- The Licensee may install the Product on multiple machines, provided that it is not used simultaneously on more than one machine by the same licensed user.
5.2. Command Line Interface (CLI)
- The Licensee may install the DocInsight CLI on a separate computer, such as a build server, strictly for automated, unattended documentation generation.
- The CLI is not to be treated as a redistributable component and may not be distributed to third parties.
5.3. Redistribution of Documentation Output
- Trial License Users: Redistribution of Documentation Output generated during the trial period is strictly prohibited.
- Licensed Users: Licensed users may redistribute Documentation Output generated using the licensed Product, provided such redistribution complies with all other terms of this EULA.
5.4. Restrictions
The Licensee shall not:
- Reverse engineer, decompile, or disassemble the Product.
- Modify, adapt, or create derivative works based on the Product.
- Rent, lease, lend, sell, sublicense, assign, distribute, publish, transfer, or otherwise make the Product available to any third party.
DevJet Software may use network connections to verify proper use of licenses, including periodic checks to confirm compliance with the terms of this EULA.
DevJet Software owns all rights to the Product, which is protected by copyright law.
THE PRODUCT IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. DEVJET SOFTWARE DOES NOT WARRANT THAT THE PRODUCT WILL MEET THE LICENSEE'S REQUIREMENTS OR THAT THE OPERATION OF THE PRODUCT WILL BE UNINTERRUPTED OR ERROR-FREE.
IN NO EVENT SHALL DEVJET SOFTWARE BE LIABLE FOR ANY DAMAGES (INCLUDING, WITHOUT LIMITATION, LOST PROFITS, BUSINESS INTERRUPTION, OR LOST INFORMATION) ARISING OUT OF THE USE OF OR INABILITY TO USE THE PRODUCT, EVEN IF DEVJET SOFTWARE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL DEVJET SOFTWARE’S TOTAL LIABILITY TO THE LICENSEE EXCEED THE AMOUNT PAID BY THE LICENSEE FOR THE PRODUCT.
The Licensee agrees that DevJet Software may include the Licensee's name and logo in marketing materials, customer lists, or websites unless the Licensee notifies DevJet Software in writing of their desire to opt out of such use.
This EULA shall be governed by and construed in accordance with the laws of the country where DevJet Software is headquartered, without regard to its conflict of law principles.
DevJet Software reserves the right to modify this EULA at any time. The updated EULA will be posted on DevJet Software's website, and continued use of the Product after changes are made constitutes acceptance of the new terms.
13.1. By Licensee The Licensee may terminate this EULA at any time by uninstalling the Product and destroying all copies of it.
13.2. By DevJet Software DevJet Software may terminate this EULA if the Licensee fails to comply with its terms. Upon termination, the Licensee must uninstall and destroy all copies of the Product.
If any provision of this EULA is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
This EULA constitutes the entire agreement between the Licensee and DevJet Software regarding the use of the Product and supersedes all prior or contemporaneous understandings, agreements, or representations, whether written or oral.
