func _() {
	var x []int
	len := func([]int) int { return 10 }

	if x == nil || len(x) == 0 {
	}
}

triggers S1009:

bar.go:7:5: should omit nil check; len() for nil slices is defined as zero (S1009)

It shouldn't.
