The following code works fine:

  <head>
    <meta name="viewport" content="width=device-width, initial-scale=1">
    <link rel="stylesheet" href="http://code.jquery.com/mobile/1.1.0-rc.1/jquery.mobile-1.1.0-rc.1.min.css" />
    <script src="http://code.jquery.com/jquery-1.7.1.min.js"></script>
    <script src="http://code.jquery.com/mobile/1.1.0-rc.1/jquery.mobile-1.1.0-rc.1.min.js"></script>
  </head>
  <body>
    <div data-role="header" data-position="inline">
      <h1>test</h1>
      <a href="index.html" data-icon="gear" class="ui-btn-right">Opt</a>
    </div>
  </body>
</html>

But simply changing the data-role to footer breaks it:

  </head>

      <a href="index.html" data-icon="gear" class="ui-btn-right">Opt</a>
    </div>
  </body>
</html>

I've tested this on Safari and Chrome and also on 1.0.1 and rc1.
