1. **Trigger — Commercial Entity status** commences the moment net income from the Work reaches **USD $10,000** in a year (§4.3.1, L148). No two-year grace for entities (§4.3.2, L150).
2. **Substance over form** — shells, pyramids, nominees, fragmentation are disregarded (§4.3.3, L152–158). Aggregation combines commonly-controlled entities (§4.3.4, L160). True beneficiary governs, not nominal holder (§4.3.5, L162).
3. **Attempted avoidance** → deemed Commercial Entity from the moment of attempt, all remedies apply, and the attempt is **recorded in the registry as public record** (§4.3.6, L164–168).
