I've observed this in GitHub actions when running on Ubuntu, and on WSL2.
I've executed chmod 775 /the/file, after which, in WSL2, directly executing the file works fine.
Given that that works fine, which is how in production my code will run, my workaround will be to not run this failing test on Ubuntu, only on Windows.
I tried to diagnose using strace. I'll just paste my work here, but I give up.
I execute the following two scripts pretty much simultaneously in separate bash shells:
dotnet test --filter Publication -l "console;verbosity=detailed"
