The Treasury has released new guidance on how to define an energy community. Read the FAQs and view the map.

Create a comparison of these changes against the existing energy community designation done in this repo.

The below list addresses the changes reflected by the new guidance:

  • switch to using TIGER 2020 shapefiles. Punted to Switch to using 2020 TIGER geometries and 2020 Census vintage #121
  • Check if MSHA filtering is done as specified in FAQs:
    • "Surface" or "Underground" type mines, "Abandoned" or "Abandoned and Sealed" status
  • Check if EIA coal plant filtering is done as specified in the FAQs:
    • at the time of being classified as "retired" it is listed a coal fired electric generating unit
    • technology is “Conventional Steam Coal” or “Coal Integrated Gasification Combined Cycle"
    • For years 2010 to 2013, coal-fired electric generating units are those listed in EIA Form 860 data as having a primary fuel source code of anthracite coal, bituminous coal, lignite coal, refined coal, coal-derived synthesis gas, subbituminous coal, and waste/other coal
  • Check if brownfields filtering is done as specified in the FAQs
    • "defined in 42 U.S.C. 9601(39) (A), (B), and (D)(ii)(III))"
  • Check MSA + non-MSA area definitions in Appendix A in IRS Notice 2023-29
  • Update fossil NAICS codes to reflect those under FAQ "How is fossil fuel employment estimated for MSAs and non-MSAs?"
  • Check/fix non-MSA boundaries in New England states according to this guidance:
    • Treasury/IRS non-MSA delineations differ from the BLS provided definitions in the New England states by strictly following county boundaries for MSA and non-MSA boundaries. For MSAs, these boundaries directly follow OMB Bulletin No. 18-03. The non-MSAs in these New England states delineated in IRS Notice 2023-29 include the counties in a BLS defined nonmetropolitan area that have no portion in an MSA
  • Handle adjoining Census tracts that are separated by a river/waterway. Punted to Switch to using 2020 TIGER geometries and 2020 Census vintage #121
