Do not work on my computer without modernizr even on Chrome.

This is normal behaviour for Pushy since it requires Modernizr for the IE 7-9 animation fallback. If you wish to not support IE 7-9, then remove the conditional in the JS that detects & tests for CSS Transforms 3D support in the browser.
