With caja from git master, this works fine in ICON view but indeed is not shown in list view. I think it has always worked this way. You are correct, this is a feature request, tagging it as such so the other devs will see it properly.
Having recently installed MATE desktop on top of of Pop!_Os 22.04, I'm having this problem because I'm used to using a folder view that's like List view.
However, I've noticed that if there are only a few files in a folder, and the window is big enough to leave some space at the bottom, then I can right click on that space and get the Create New option in Caja (with List view).
I'm not suggesting this as a solution, because it rarely applies, but it shows that Caja does have that capability.
I wonder if it would be possible to add gutters to list view, which would be treated as empty space, as with Windows, where I can right click to the left of the folder icons and file icons, or to the right of the file details, in Details view (which is equivalent to Caja's List view), to get a general context menu, rather than one relating to a specific file.
In Caja, there is no space to do that, so any right click relates to a file, unless it's in empty space below the list of files, which usually isn't there.
