vir<lb break="no" ed="Bd" n="39"/>tutis sit in praecepto, ita deberet diffiniri

obedien<lb break="no" ed="Bd" n="41"/>tia : et maxime videtur, quod per
<lb ed="Bd" n="42"/>charitatem : quia ut dicit Apostolus,
<lb ed="Bd" n="43"/>Finis precepti est charitas de corde puro,
<lb ed="Bd" n="44"/>et conscientia bona, et fide non ficta'.

<lb ed="Bd" n="46"/>praecepti quae datur ab Augustino, datur
<lb ed="Bd" n="47"/>de ipso in quantum est obligatorium ad
<lb ed="Bd" n="48"/>differentiam consilii: et ideo sequitur in
<lb ed="Bd" n="49"/>littera sic: <quote xml:id="alalal-f31961-Qd1e260"> Praceptum est cui non obe.-
<lb ed="Bd" n="50"/>dire peccatum est: non consilium, quo
<lb ed="Bd" n="51"/>si uti volueris, minus boni adipisceris,
<lb ed="Bd" n="52"/>non mali aliquid perpetrabis. </quote> Et ideo
<lb ed="Bd" n="53"/>si quis vellet diffinire praeceptum
secun<lb break="no" ed="Bd" n="54"/>dum substantiam secundum quam est
<lb ed="Bd" n="55"/>obligatorium, posset diffinire sic:

obser<lb break="no" ed="Bd" n="57"/>vationem actus imperati ex auctoritate
<lb ed="Bd" n="58"/>imperantis, vel ex ratione rei imperate.
<lb ed="Bd" n="59"/>Preceptum enim est in omni genere
<lb ed="Bd" n="60"/>imperii, et obligat quandoque tantum,
<lb ed="Bd" n="61"/>quia praeceptum est et non ex se:
quan<lb break="no" ed="Bd" n="62"/>doque autem ex seipso. Sed Augustinus
<lb ed="Bd" n="63"/>accipit in communi modum obligationis
<lb ed="Bd" n="64"/>qui est in praecepto.

<lb ed="Bd" n="69"/>praeceptum est de eadem re de qua est
<lb ed="Bd" n="70"/>consilium: ut si non possum honorare
<lb ed="Bd" n="71"/>proximum nisi omnia vendam, tunc

<lb ed="Bd" n="73"/>in tempore necessitatis, cum moriuntur
<lb ed="Bd" n="74"/>pauperes fame nisi vendam: et si ex voto
<lb ed="Bd" n="75"/>necessarium fiat consilium, quia reddere
<lb ed="Bd" n="76"/>est precepti, licet vovere sit consilii.

du<lb break="no" ed="Bd" n="78"/>pliciter consideratur, scilicet in
voven<lb break="no" ed="Bd" n="79"/>do, et reddendo. Si accipiatur in
vo<lb break="no" ed="Bd" n="80"/>vendo: tunc non obedire non est
pec<lb break="no" ed="Bd" n="81"/>catum, quia vovere est consilii : sed
<lb ed="Bd" n="82"/>obedire adipiscitur majus bonum,. Si
au<lb break="no" ed="Bd" n="83"/>tem consideratur in reddendo : tune
<lb ed="Bd" n="84"/>obligat necessario: sed hoc ideo, quia
<lb ed="Bd" n="85"/>reddere est precepti.

<lb ed="Bd" n="87"/>non oportet obedire nisi in quantum ipsa
<lb ed="Bd" n="88"/>respicit praeceptum : sed obedientia
obe<lb break="no" ed="Bd" n="89"/>dit praecepto: et ideo nihil est dictum,
<lb ed="Bd" n="90"/>quod obedientia est cui obeditur, nisi
<lb ed="Bd" n="91"/>obedientia sumatur vulgariter pro re
in<lb break="no" ed="Bd" n="92"/>juncta ex praecepto : sicut religiosi dicere

obedi<lb break="no" ed="Bd" n="4"/>tur Prelato, et aliter preecepto : Preelato
<lb ed="Bd" n="5"/>scilicet sicut imperanti: praecepto autem
<lb ed="Bd" n="6"/>sicut ei quod mandatur exsecutioni per
<lb ed="Bd" n="7"/>obedientiam qua obligamur ad. ipsum.

<lb ed="Bd" n="9"/>Scriptures ut regule et doctrine fidei et
<lb ed="Bd" n="10"/>morum, sed praeceptis ut obligantibus
<lb ed="Bd" n="11"/>ad opus. Kt differentia hujus obedientia
<lb ed="Bd" n="12"/>accipitur ex hoc quod dicit, cui non
obe<lb break="no" ed="Bd" n="13"/>dire est peccatum : non enim
universali<lb break="no" ed="Bd" n="14"/>icr non obedire Scripture est peccatum.

sequi<lb break="no" ed="Bd" n="16"/>tur si non obedire peccatum est, quod
<lb ed="Bd" n="17"/>obedire sit meritum : quia multa
exi<lb break="no" ed="Bd" n="18"/>guntur ad meritum praeter impletionem
<lb ed="Bd" n="19"/>actus preecepti: sed nihil exigitur ad
pec<lb break="no" ed="Bd" n="20"/>catum praeter transgressionem precepti,
<lb ed="Bd" n="21"/>que est in nostra potestate.

<lb ed="Bd" n="23"/>particularia possunt esse affirmativa, et
<lb ed="Bd" n="24"/>sunt de opere cujuslibet virtutis : sed in
<lb ed="Bd" n="25"/>decalogo non assignantur praecepta nisi
<lb ed="Bd" n="26"/>generalitsr, prout continentur in jure
<lb ed="Bd" n="27"/>naturali, ut infra patebit.

<lb ed="Bd" n="28"/>Ad ultimum dicendum, quod dilectio
si<lb break="no" ed="Bd" n="29"/>ve charitas non respicit praeceptum,sed
po<lb break="no" ed="Bd" n="30"/>tius id quod est praeceptum in quantum est
<lb ed="Bd" n="31"/>opus meritorium: sed obedientia respicit
<lb ed="Bd" n="32"/>praeceptum in quantum est praeceptum,
<lb ed="Bd" n="33"/>et ideo potius diffinitur praeceptum per
<lb ed="Bd" n="34"/>actum obedientiae quam charitatis.
