<lb ed="#Be" n="63"/>quantum ad primum objectum, quod
<lb ed="#Be" n="64"/>aliud est judicium et potestas sacerdotis,
<lb ed="#Be" n="65"/>in quantum sacerdos est habens claves
<lb ed="#Be" n="66"/>et auctoritatem judicis in foro
posniten<lb break="no" ed="#Be" n="67"/>tie: et aliud judicium hominis:
judi<lb break="no" ed="#Be" n="68"/>cium enim sacerdotis in quantum
hu<lb break="no" ed="#Be" n="69"/>jusmodi, est secundum canones pensatis
<lb ed="#Be" n="70"/>peccatis et statu poenitentis, et hoc
num<lb break="no" ed="#Be" n="71"/>quam errat, nec est malitiosum :
judi<lb break="no" ed="#Be" n="72"/>cium autem hominis quod sepe
erro<lb break="no" ed="#Be" n="73"/>neum est et malitiosum, non tenetur

<lb ed="#Be" n="76"/>dico sine prajudicio, quod quia

ne<lb break="no" ed="#Be" n="78"/>cessitatis, ut dicit Augustinus, non
pot<lb break="no" ed="#Be" n="79"/>est injungi in foro poenitentiae, nisi sub
<lb ed="#Be" n="80"/>conditione, si pcenitens eam suscipere
<lb ed="#Be" n="81"/>voluerit: omnia enim quae
supereroga<lb break="no" ed="#Be" n="82"/>tionis sunt, laudabilia quidem sunt si
<lb ed="#Be" n="83"/>fiant, sed nullus est ad ea cogendus.

<lb ed="#Be" n="85"/>objicitur, dicendum quod canones non
<lb ed="#Be" n="86"/>injungunt per modum necessitatis, sed
<lb ed="#Be" n="87"/>per modum consilii ad terrorem
alicu<lb break="no" ed="#Be" n="88"/>jus peccati, quod exigit poenitentiam
<lb ed="#Be" n="89"/>majorem quam alia, et per totam vitam.

<lb ed="#Be" n="91"/>Sodomam significat inclinantia in

<lb ed="#Be" n="93"/>permissum est Lot ibi- habitare, nisi ex
<lb ed="#Be" n="94"/>voluntate declinasset ad montem : et
<lb ed="#Be" n="95"/>ideo dictum Angeli reducitur ad

<lb ed="#Be" n="7"/>suum de se: et hoc non potest fieri in
<lb ed="#Be" n="8"/>poenitentia, nisi quantum ad quedam,
<lb ed="#Be" n="9"/>et non quoad omnia.

<lb ed="#Be" n="10"/>Ad Aurop dicendum, quod poenitentia
<lb ed="#Be" n="11"/>bene potest prolongari per totam vitam,
<lb ed="#Be" n="12"/>et etiam plus, si vita plus durare posset:
<lb ed="#Be" n="13"/>sed tamen non sequitur, quod religio
<lb ed="#Be" n="14"/>possit injungi: quia religio supra
perpe<lb break="no" ed="#Be" n="15"/>tuitatem ponit propriae voluntatis in
om<lb break="no" ed="#Be" n="16"/>nibus abdicationem et carentiam proprii,
<lb ed="#Be" n="17"/>ad quae nullus tenetur, nisi ex propria
<lb ed="#Be" n="18"/>voluntate ea eligat: et ideo non potest

pec<lb break="no" ed="#Be" n="24"/>canti, et non peccanti: poenitentia enim

<lb ed="#Be" n="26"/>peceavit, et etiam confessio: sed non est
<lb ed="#Be" n="27"/>ei in precepto qui non peccavit. Sed

<lb ed="#Be" n="40"/>emendari potest, sine poenitentia autem
