<lb ed="#Bf" n="7"/>1. Omne enim impedimentum
alicu<lb break="no" ed="#Bf" n="8"/>jus contrarietatem aliquam habet ad
<lb ed="#Bf" n="9"/>aliud: sed servitus nullam habet
contra<lb break="no" ed="#Bf" n="10"/>rictatem ad matrimonium : ergo non
<lb ed="#Bf" n="11"/>impedit ipsum. Prosarur autem prima:
<lb ed="#Bf" n="12"/>quia nihil impedit aliud, nisi quod in
<lb ed="#Bf" n="13"/>contrarium operatur vel agit: et agens
<lb ed="#Bf" n="14"/>in contrarium, est contrarium
necessa<lb break="no" ed="#Bf" n="15"/>rio. Srcunpa autem patet : quia servus
<lb ed="#Bf" n="16"/>potest habere fidem, prolem, et

<lb ed="#Bf" n="19"/>genere, aut ex differentia addita. Si ex
<lb ed="#Bf" n="20"/>gencre : ergo omnis conditio impediret
<lb ed="#Bf" n="21"/>matrimonium, quod falsum est, cum
<lb ed="#Bf" n="22"/>conditio libertatis non impediat. Si autem
<lb ed="#Bf" n="23"/>ex differentia contrahente. Contra: Ergo
<lb ed="#Bf" n="24"/>omnis servitus impedit, et semper : ergo
<lb ed="#Bf" n="25"/>etservus cum ancilla contrahere non
pot<lb break="no" ed="#Bf" n="26"/>est, quod falsum est: ergo conditio
ser<lb break="no" ed="#Bf" n="27"/>vilis non impedit matrimonium.

<lb ed="#Bf" n="29"/>aliquid ex natura sui aliquid impedit,
<lb ed="#Bf" n="30"/>quod illud multiplicatum plus impedit :
<lb ed="#Bf" n="31"/>ergo si seryitus impedit matrimonium,
<lb ed="#Bf" n="32"/>multiplicata servitus plus impedit ipsum :
<lb ed="#Bf" n="33"/>sed hoc est falsum, quia servus cum an-~
<lb ed="#Bf" n="34"/>cilla contrahere potest, cum tamen in eis
<lb ed="#Bf" n="35"/>sit multiplicata servitus: ergo hoc est
<lb ed="#Bf" n="36"/>falsum, quod servitus impediat

matri<lb break="no" ed="#Bf" n="39"/>moni ante existenti supervenit ex
ultio<lb break="no" ed="#Bf" n="40"/>ne peccati, sicut et ali pane : sed ego
<lb ed="#Bf" n="41"/>video, quod alia pone non impediunt :

<lb ed="#Bf" n="44"/>est contractus ancillae cum libero, quam
<lb ed="#Bf" n="45"/>libere cum libero: ergo etiam in signo

an<lb break="no" ed="#Bf" n="47"/>cilla cum ingenuo, quam ingenue cum

<lb ed="#Bf" n="58"/>1. Omnis deceptio et fraus rescindunt
<lb ed="#Bf" n="59"/>contractum : sed si ingenuus cum ancilla
<lb ed="#Bf" n="60"/>ignoranter contrahat, ibi est deceptio :
<lb ed="#Bf" n="61"/>ergo contractus rescindendus est.

<lb ed="#Bf" n="63"/>partim propter se, et partim propter
<lb ed="#Bf" n="64"/>aliud expetendis, ut dicit Philosophus :
<lb ed="#Bf" n="65"/>libertas auten: est de per se expetendis,
<lb ed="#Bf" n="66"/>servitus autem de fugiendis: ergo
liber<lb break="no" ed="#Bf" n="67"/>tas convenit cum ratione boni appelibilis
<lb ed="#Bf" n="68"/>matrimonio, et servilus contrariatur :
<lb ed="#Bf" n="69"/>sed contrarium impedit : ergo servitus

condi<lb break="no" ed="#Bf" n="82"/>tione, scilicet libertatis, impedit matri--
<lb ed="#Bf" n="83"/>monium contrahendum, et dirimit

con<lb break="no" ed="#Bf" n="90"/>sequentia, scilicet ad debiti reddilionem,

differen<lb break="no" ed="#Bf" n="6"/>tia impedit, et argumentum non
sequi<lb break="no" ed="#Bf" n="7"/>tur: quia differentia non habet
contra<lb break="no" ed="#Bf" n="8"/>rietatem ad se in alio individuo, sed
po<lb break="no" ed="#Bf" n="9"/>tius ad differentiam oppositam : sicut
pa<lb break="no" ed="#Bf" n="10"/>tet, quod rationale in Platone non
contra<lb break="no" ed="#Bf" n="11"/>riatur rationali in Socrate, sed
irrationa<lb break="no" ed="#Bf" n="12"/>li contrariatur. Ita conditio servitutis non
<lb ed="#Bf" n="13"/>opponitur servituti matrimonii, sed
po<lb break="no" ed="#Bf" n="14"/>tius libertati, et cum illa impedit
matri<lb break="no" ed="#Bf" n="15"/>monium.

<lb ed="#Bf" n="17"/>est de illo ad quod habet
contra<lb break="no" ed="#Bf" n="18"/>rium, sed suum simile magis
augmen<lb break="no" ed="#Bf" n="19"/>tat : et ideo si posset multiplicari
servi<lb break="no" ed="#Bf" n="20"/>tus contra libertatem in matrimonio,
be<lb break="no" ed="#Bf" n="21"/>ne concedendum esset, quod magis
im<lb break="no" ed="#Bf" n="22"/>pediret : sed hoc esse non potest, cum
<lb ed="#Bf" n="23"/>una sit unius tantum: et ideo illud
ar<lb break="no" ed="#Bf" n="24"/>gumentum non cogit.

<lb ed="#Bf" n="26"/>in utroque sunt conjugum, et non augent
<lb ed="#Bf" n="27"/>onera matrimonii, nec faciunt ipsum
<lb ed="#Bf" n="28"/>violioris conditionis in bonis suis: sed
<lb ed="#Bf" n="29"/>hec omnia facit servitus: et ideo non est
<lb ed="#Bf" n="30"/>simile.

omni<lb break="no" ed="#Bf" n="34"/>bus : et ideo iterum non est simile.

<lb ed="#Bf" n="36"/>nostra ancilla est in hoc quod suorum
<lb ed="#Bf" n="37"/>operum non est tota causa: sed
ancilla<lb break="no" ed="#Bf" n="38"/>tio illa non tradit eam in potestatem
con<lb break="no" ed="#Bf" n="39"/>trarii domini: et ideo equivocatio est in
<lb ed="#Bf" n="40"/>argumento : quidquid tamen in nobis sit
<lb ed="#Bf" n="41"/>qui frequenter peccavimus, et ideo servi
<lb ed="#Bf" n="42"/>peceati secundum aliquein modum
