<lb ed="#L" n="106"/>in generali &

<lb ed="#L" n="108"/>CIINDVM est eriam, quia cuminomibus.
<lb ed="#L" n="109"/>Superius de terminauit magister de illis in quibus
<lb ed="#L" n="110"/>actus matrimonialis excusatur: hic determinat
<lb ed="#L" n="111"/>de ipso actu secundum quod accipit rationem
de<lb ed="#L" n="112" break="no"/>biti. Et diuiditur in duas. Primo determinat de
<lb ed="#L" n="113"/>necessitate reddendi debitum. Secundo de tempore exigendi
<lb ed="#L" n="114"/>ibi, Et licet debitum poscenti. Prima in tres. Primo ostendit
<lb ed="#L" n="115"/>quod vir et vxor sunt aequales in debiti redditione. Secundo
<lb ed="#L" n="116"/>probat quod supposuerat, scilicet quod non potest coniunx
<lb ed="#L" n="117"/>sine licentia coniugis continentiam vouere. Tertio inquirit
an<lb ed="#L" n="118" break="no"/>data licentia posset reuocari. Secunda ibi, Quod vero sine
con<lb ed="#L" n="119" break="no"/>sensu. Tertia ibi, Si vero quilibet eorum. Secunda pars
princi<lb ed="#L" n="120" break="no"/>palis in qua determinat de tempore exigendi debitum,
diuidi<lb ed="#L" n="121" break="no"/>tur in tres. Primo ostendit quod aliquando cessandum est a

<lb ed="#L" n="127"/>quod quum vir praesit in omnibus mulieri, sicut caput
corpo<lb ed="#L" n="128" break="no"/>ri, in redditione tamen debiti sunt pares, quia alter alterius
ha<lb ed="#L" n="129" break="no"/>bet potestatem, nec altero poscente, licet alteri denegare
debi<lb ed="#L" n="130" break="no"/>tum, siue hoc poscat causa prolis generandae, siue
incontinen<lb ed="#L" n="131" break="no"/>tiae animorum, quod auctoritatibus confirmat: vbi etiam
di<lb ed="#L" n="132" break="no"/>cit quod sicut alter alterius habet potestatem, ita quod nec mu
<lb ed="#L" n="133"/>lier ad alium maritum: nec vir ad aliam mulierem habet
pote<lb ed="#L" n="134" break="no"/>statem accedendi, ita etiam nec vir ad continendum habet sui
<lb ed="#L" n="135"/>corporis potestatem, nec mulier nisi de mutuo consensu: vbi
<lb ed="#L" n="136"/>etiam subdit quod reddere coniugale debitum nullius est crimi
<lb ed="#L" n="137"/>nis, exigere vero vltra generandi necessitatem venialis est
cul<lb ed="#L" n="138" break="no"/>pae, sed fornicari vel moechari poenitendi est criminis. Postea
<lb ed="#L" n="139"/>pluribus auctoritatibus confirmat quod nec coniuges
aper<lb ed="#L" n="140" break="no"/>te nec fraudulenter a carnali debito ad inuicem sine communi
<lb ed="#L" n="141"/>consensu continere possunt, quod supra supposuerat. Postea
<lb ed="#L" n="142"/>quaerit si vir vxori consentiat quod continentiam Deo offerat
<lb ed="#L" n="143"/>& a suo iure eam absoluit, vtrum possit post datam licentiam
<lb ed="#L" n="144"/>reuocare? Et respondet quod sic, in hoc scilicet casu si ei conces
<lb ed="#L" n="145"/>serat vouere continentiam, & ante votum prohibet implere, si
<lb ed="#L" n="146"/>autem post, reuocare non potest. Postea dicit quod quilibet de
<lb ed="#L" n="147"/>bet debitum poscenti reddere, non tamen licet quolibet die po
<lb ed="#L" n="148"/>scere, sicut in diebus festiuis, & ieiuniorum, & processionis,
<lb ed="#L" n="149"/>quod auctoritatibus probat. Postea dicit quod Heronymus
<lb ed="#L" n="150"/>vult quod reddere debitum quandoque est peccatum, quod est
<lb ed="#L" n="151"/>contra supradicta. Hieronymus enim dicit quod qui vxori
de<lb ed="#L" n="152" break="no"/>bitum reddit non potest orationibus vacare, nec carnes agni co
<lb ed="#L" n="153"/>medere, nec sumere eucharistiam. Dicit etiam quod non semper
<lb ed="#L" n="154"/>est reddendum debitum, vt diebus quibus est orationi vacandum,
<lb ed="#L" n="155"/>& eucharistia sumenda: & respondet quod dictum illod
referen<lb ed="#L" n="156" break="no"/>dum est ad ecclesiae ministros quibus non licet sacra offerre vel
<lb ed="#L" n="157"/>missam celebrare tempore coniugalis amplexus. Vitimo dicit
<lb ed="#L" n="158"/>quod sicut in carnali commistione, sic etiam in celebrandis
nu<lb ed="#L" n="159" break="no"/>ptiis sunt tempora obseruanda: quia non quibuscunque tempo
<lb ed="#L" n="160"/>ribus sunt nuptiae celebrandae, sicut auctoritatibus
concilio<lb ed="#L" n="161" break="no"/>rum declarat.
