<lb ed="#L" n="123"/>marrimonium sine consensu domini sui. Et

obli<lb ed="#L" n="125" break="no"/>gat se Deo quam illa qua vir obligat se vxori, sed

<lb ed="#L" n="138"/>domino. Cuius ratio est, quia sicut dictum est in praecedenti
quae<lb ed="#L" n="139" break="no"/>stione, ius positiuum determinat ius naturale & ei non
praeiudi<lb ed="#L" n="140" break="no"/>cat, matrimonium autem est de iure naturali; seruitus autem de
<lb ed="#L" n="141"/>iure positiuo, ergo per seruiturem nullus potest impediri totali
<lb ed="#L" n="142"/>ter a matrimonio. Minor patet, quia sicut appetitus naturalis
<lb ed="#L" n="143"/>est ad conseruationem indiuidui per comestionem, ita ad
conser<lb ed="#L" n="144" break="no"/>uationem speciei per generationem: & ideo sicut seruus non
sub<lb ed="#L" n="145" break="no"/>ditur duno quin possit comedere & bibere, & ea quae sunt
ne<lb ed="#L" n="146" break="no"/>cessaria corpori facere sine quibus natura conseruari non potest,
<lb ed="#L" n="147"/>ita non subditur ei quin possit matrimonium contrahere dno
<lb ed="#L" n="148"/>ignorante & contradicente. Hoc autem interest, quia si seruus
<lb ed="#L" n="149"/>cotraxisset domino sciente & permittente, seruus magis
tene<lb ed="#L" n="150" break="no"/>retur reddere debitum vxori, quam seruitium domino, quando
<lb ed="#L" n="151"/>vtrunque non posset fieri, quia dominus qui scienter concessit
<lb ed="#L" n="152"/>principale, videtur concessisse & accessorium. Si autem domino
<lb ed="#L" n="153"/>ignorante, aut contradicente, tunc magis tenetur impendere
<lb ed="#L" n="154"/>seruitium domino quam reddere debitum vxori, nisi notabile
<lb ed="#L" n="155"/>periculum immines et de incontinentia vxoris, & modicum
<lb ed="#L" n="156"/>damnum dno, de subtractione seruitij pro tempore illo: haec
<lb ed="#L" n="157"/>enim & similia considerari debentia actibus humani, qui

redde<lb ed="#L" n="2" break="no"/>re debitum vxori non semper, sed congruis temporibus: & ideo
<lb ed="#L" n="3"/>plus impeditur seruitium dhi per ingressum religionis vel
<lb ed="#L" n="4"/>susceptionem ordinis quam per matrimonium, propter quod non
<lb ed="#L" n="5"/>est simile hinc & inde. Vel melius, quia preligionem & ordinis
<lb ed="#L" n="6"/>susceptionem subiicitur homo praelato quantum ad opera
volun<lb ed="#L" n="7" break="no"/>taria naturalibus superaddita in quibus seruus obligatur dino
<lb ed="#L" n="8"/>suo, sed per matrimonium non obligatur vir vxori, nisi que
<lb ed="#L" n="9"/>ad opera naturalia in quibus est liber: & ideo majus praeiudicium
<lb ed="#L" n="10"/>fit dno si seruus sine consensu eius ordinem suscipiat vel
