<lb ed="#L" n="61"/>CIRCA distinctionem istam quaeritur, vtrum
sace<lb ed="#L" n="62" break="no"/>ordo impediat matrimonium. Et videtur quod non
<lb ed="#L" n="63"/>quia aut hoc esset ratione ordinis, vel ratione voti
<lb ed="#L" n="64"/>et annexi, aut ratione statuti ecclesiastici: non ratio.
<lb ed="#L" n="65"/>ne ordinis, quia sic omnis ordo impediret, quod non est

<lb ed="#L" n="94"/>quod ordo sacer habet impedire matrimonium contrahendum, &
<lb ed="#L" n="95"/>dirimere contractum ex se quidem dispositiue, sed ex statuto ecele
<lb ed="#L" n="96"/>siae completiue. Quod patet fic: minister debet congruere mini
<lb ed="#L" n="97"/>sterio ad quod ordinatur, sed constituti in sacris non congrueren
<lb ed="#L" n="98"/>ministerio ad quod ordinantur si contraherent, ergo constituti in
<lb ed="#L" n="99"/>sacris non debent contrahere. Minor declaratur, quia clericis in
<lb ed="#L" n="100"/>sacris sunt ministri Dei quo ad confectionem & dispensationem
<lb ed="#L" n="101"/>ministeriorum diuinorum, sunt etiam ministri ecclesiae quo ad
di<lb ed="#L" n="102" break="no"/>spensacionem rerum ecelesiasticarum: ad ministerium vero diuinum

<lb ed="#L" n="107"/>corpus, & contemplationem, quia occupat circa negocia seculi,
<lb ed="#L" n="108"/>propter quod tollit idoneitatem ad diuinum ministerium.
<lb ed="#L" n="109"/>Similiter ad ministerium ecelesiasticum duo sunt necessaria scilicet
<lb ed="#L" n="110"/>diligentia in administrando, & cautela in conseruando:
matri<lb ed="#L" n="111" break="no"/>monium autem impedit diligentiam, quia occupatus circa
pro<lb ed="#L" n="112" break="no"/>pria minus curat de communionibus: impedit etiam cautelam,
<lb ed="#L" n="113"/>quia in priuatos vsus vxoris & filiorum faceret expendi bona
<lb ed="#L" n="114"/>pauperum, & ideo non congruit quod promoti in sacris possini
<lb ed="#L" n="115"/>matrimonium contrahere. Huic autem congruentiae superueniens
<lb ed="#L" n="116"/>statutum ecelesiae fecit clericos in sacris constitutos personas sim
<lb ed="#L" n="117"/>pliciter illegitimas ad matrimonia contrahenda, ita vt si de
<lb ed="#L" n="118"/>facto contrahantur dirimi debeant tanquam nulla, vt
habe<lb ed="#L" n="119" break="no"/>tur expresse extra qui clerici, vel vouentes contrahere non
<lb ed="#L" n="120"/>possunt, ex literarum. Et eadem ratione debet eis indici
conti<lb ed="#L" n="121" break="no"/>nentia quando ordinantur inquam sine consentiant, sine non, 8

<lb ed="#L" n="128"/>votum potest adiungi alicui facto, nisi vouens voluntarie consen

<lb ed="#L" n="130"/>est mere voluntatis, sed impedit completiue ex statuto

<lb ed="#L" n="132"/>sacrum ordinem receperunt. Et quod dicitur quod matrimonium
<lb ed="#L" n="133"/>contractum contra interdictum ecclesiae non dirimitur, dicen
<lb ed="#L" n="134"/>dum est quod ecelesis aliqua interdicit simplici prohibitione ne
<lb ed="#L" n="135"/>fiant, sed si facta fuerint non irritat: alia vero interdicit nos
<lb ed="#L" n="136"/>solum prohibendo ne fiant, sed statuendo vt irritum fit & inane
<lb ed="#L" n="137"/>si contra statutum fiat, & tunc non solum prohibetur faciendum,
<lb ed="#L" n="138"/>sed irritatur factum. Primo modo interdicitur matrimonium
<lb ed="#L" n="139"/>contrahi tempore feriato & in pluribus casibus. Sed secundo
<lb ed="#L" n="140"/>modo prohibetur in susceptione ordinis.
