divisio commissionis et delicti. Nam di<lb ed="#Qc"/>visio
delicti attenditur secundum defectus illorum
<lb ed="#Qc"/>in quibus prius et posterius ordinatur bonum:
<lb ed="#Qc"/>haec enim ordinantur secundum prius et poste<lb ed="#Qc"/>rius,
scire, velle et operari in circumstantiis

<lb ed="#Qc"/>debitis. Commissio vero non sic dividitur, sed se<lb ed="#Qc"/>cundum
differentias actionum in specie; secun<lb ed="#Qc"/>dum
differentias etiam boni et mali, prout qui<lb ed="#Qc"/>dam
actus sunt respectu boni, quidam respectu
<lb ed="#Qc"/>mali, et nihil prohibet has et illas esse formales,

se habent commissio et delictum, sicut est
<lb ed="#Qc"/>de actu credendi. Et similiter potest esse de actu
