<lb ed="#Qc"/>significatio cum intentione fallendi</quote>. Et hoc idem
<lb ed="#Qc"/>habetur in <title>Glossa</title><!--3--> super illud <title>Psalmi</title><!--4-->: <quote>Per<lb ed="#Qc"/>des
omnes qui loquuntur mendacium</quote>.
</p>

<lb ed="#Qc"/>Obicitur autem circa<!--a--> hanc definitionem. 1.
<lb ed="#Qc"/>Contingit simulationem facere in operibus sicut
<lb ed="#Qc"/>in verbis: unde sicut mendacium est in falsis
<lb ed="#Qc"/>verbis, ita in operibus simulatis; ergo non tan<lb ed="#Qc"/>tum
est mendacium <quote xml:id="ahsh-l2Bi3t3s2q2c1-Qd1e142">falsa vocis significatio</quote>.

<lb ed="#Qc"/>2. Item, aliquis dicit aliquod verum, et tamen
<lb ed="#Qc"/>intendit fallere; constat quod iste peccat; et<!--b--> non

<lb ed="#Qc"/>mendacium; ergo non universaliter est menda<lb ed="#Qc"/>cium

ergo non convenit omni mendacio.

Aliquis enim dicit falsum ut salvet ali<lb ed="#Qc"/>quem:
principalis intentio eius fuit circa salutem
<lb ed="#Qc"/>alterius; ergo non est principalis intentio fallendi;
<lb ed="#Qc"/>est tamen mendacium; ergo non convenit omni
<lb ed="#Qc"/>mendacio.

<lb ed="#Qc"/>5. Item, sophistae disputando tota die falsum di<lb ed="#Qc"/>cunt
et intendunt fallere. Numquid omnes peccant?

<lb ed="#Qc"/>[Solutio]: Ad quod dicendum quod illa defi<lb ed="#Qc"/>nitio
est generalis mendacii<!--d--> simpliciter. Secun<lb ed="#Qc"/>dum
enim <name>Augustinum</name> requiruntur duo in
<lb ed="#Qc"/>mendacio simpliciter dicto: quod proferens dicat
<lb ed="#Qc"/>falsum et quod intendat dicere falsum. Ex qua
<lb ed="#Qc"/>dispositione est ut possit aliquis falli, ut sic sit
<lb ed="#Qc"/>falsitas ex parte intendentis et ex parte signi.

<lb ed="#Qc"/>[Ad obiecta]: 1. Ad primo autem obiectum
<lb ed="#Qc"/>dicendum est quod mendacium non proprie di<lb ed="#Qc"/>citur
in factis, licet sit ibi simulatio. Verbum enim
<lb ed="#Qc"/>proprie ordinatur ad significandum, mendacium
<cb ed="#Qc" n="b"/>
<lb ed="#Qc"/>autem dicitur a dictione<!--e--> mentis; quia ergo mens
<lb ed="#Qc"/>dicit per verbum, ideo recte dicitur mendacium
<lb ed="#Qb"/><quote xml:id="ahsh-l2Bi3t3s2q2c1-Qd1e233">falsa vocis significatio </quote>.

<lb ed="#Qc"/>2. Ad secundum vero<!--f--> dicendum quod ille
<lb ed="#Qc"/>qui dicendo verum intendit fallere non peccat
<lb ed="#Qc"/>mendacio nisi quoad quid; unde et illud genus
<lb ed="#Qc"/>peccati dicetur secundum quid mendacium.

<lb ed="#Qc"/>3. Ad tertium dicendum quod, licet ille, qui
<lb ed="#Qc"/>peccat mendacio iocoso, non intendat decipere,
<lb ed="#Qc"/>intendit<!--g--> tamen dicere falsum, ex quo posset
<lb ed="#Qc"/>esse in aliquo deceptio. Unde convenit ei ratio
<lb ed="#Qc"/>mendacii: est enim intentio falsum dicendi.

<lb ed="#Qc"/>4. Ad quartum dicendum quod in mendacio
<lb ed="#Qc"/>officioso simul est utraque pars mendacii. Licet
<lb ed="#Qc"/>enim sit ulterior intentio, scilicet iuvare proxi<lb ed="#Qc"/>mum,
nihilominus citerior<!--h--> est intentio fallendi:
<lb ed="#Qc"/>et quoad hoc dicetur mendacium. Illa enim in<lb ed="#Qc"/>tentio
per se respicit sermonem, altera vero in<lb ed="#Qc"/>tentio
respicit voluntatem et non per se sermonem.

<lb ed="#Qc"/>5. Ad quintum dicendum quod, licet sophi<lb ed="#Qc"/>stae
dicant falsum et intendant fallere et ita di<lb ed="#Qc"/>cant
mendacium, tamen, quia hoc faciunt causa
<lb ed="#Qc"/>exercitii et<!--i--> ut non ignoretur virtus nominum,
<lb ed="#Qc"/>non est peccatum.

<lb ed="#Qb"/>— contingit enim aliquem dicere verum cum in<lb ed="#Qc"/>tentione
fallendi et contingit dicere falsum non
<lb ed="#Qc"/>cum intentione fallendi — quare plus accedit ad
<lb ed="#Qc"/>rationem mendacii privatio primae partis cum
<lb ed="#Qc"/>positione secundae quam positio primae partis
<lb ed="#Qc"/>cum privatione secundae?

ad esse mendacii intentio fallendi quam falsa
<lb ed="#Qc"/>vocis significatio. Falsa enim vocis significatio est
<lb ed="#Qc"/>sicut materiale in mendacio, complementum autem
<lb ed="#Qc"/>est intentio fallendi, et ideo, ubi remanet intentio
<lb ed="#Qc"/>fallendi, plus dicitur mendacium; nihilominus
<lb ed="#Qc"/>tamen utrumque est mendacium secundum quid.
