<lb ed="#Qc"/>ergo secundum Legem quod poena mortis debea<lb ed="#Qc"/>tur;
in Lege autem videmus quod furtum<!--s--> puni<lb ed="#Qc"/>tur
poena pecuniaria, sicut habetur <title>Exod.</title> 22, 1-12;
<lb ed="#Qc"/>e contra vero furtum modo punitur poena mortis,

septennis poenitentia iniungitur; et accipitur
<lb ed="#Qc"/>hoc ex Veteri Testamento ex exemplo <quote xml:id="ahsh-l2Bi3t5s2q1t2c4-Qd1e151">David,
<lb ed="#Qc"/>qui de adulterio reprehensus, unius hebdomadae

<lb ed="#Qc"/>fuit in Veteri Testamento et aliter nunc est

<lb ed="#Qc"/>secundum legem civilem sive saecularem. In Lege
<lb ed="#Qc"/>enim Veteri iniuria in personam vel in illam quae
<lb ed="#Qc"/>quasi est eadem persona, morte mulctabatur,
<lb ed="#Qc"/>iniuria vero in rem per poenam huiusmodi pu<lb ed="#Qc"/>niebatur:
sic enim erat poena talionis<!--1-->. Nunc au<lb ed="#Qc"/>tem<!--a-->
furtum poena punitur mortis<!--b2-->, non propter
<lb ed="#Qc"/>iniuriam in ipsa re, sed propter cohertionem pm<lb ed="#Qc"/>nitatis
et pacis communis conservationem; adul<lb ed="#Qc"/>terium

originalis concupiscentiae ex una parte et

non secundum quantitatem singulorum

iniungitur exemplo Mariae sororis Moysi<!--4-->,

13: <quote>Septem annis veniet tibi fames in terra

<lb ed="#Qc"/>cui debetur poena aeterna, homo in praesenti vita
<lb ed="#Qc"/>universalem debet sustinere afflictionem<!--g5-->. Si ta<lb ed="#Qc"/>men
crimina sunt maiora vel minora, secundum
<lb ed="#Qc"/>genus peccati vel circumstantias ex parte personae
