divinae legis accipitur iste triplex processus.

derivetur, ita nec iudicialis<!--b--> sanctio auctori<lb ed="#Qd"/>tatem
videtur habere nisi per Novam vel Legem

<lb ed="#Qd"/>II. Item, qua ratione iste triplex iudicii pro<lb ed="#Qd"/>cessus
distinguitur merito dubitatur. Nam iuris<lb ed="#Qd"/>periti
distinguunt sic: quod in accusatione agitur
<lb ed="#Qd"/>ad degradationem, et ideo accusator debet se
<lb ed="#Qd"/>obligare ad talionem. Unde propter hoc dicit <name>In<lb ed="#Qd"/>nocentius</name>
quod accusationem praecedat legi<lb ed="#Qd"/>tima
inscriptio. Item, in denuntiatione agitur ad
<lb ed="#Qd"/>poenitentiam et correctionem, et ideo debet prae<lb ed="#Qd"/>cedere
caritativa admonitio. Item, in inquisitione
<lb ed="#Qd"/>agitur ad amotionem<!--c--> ab administratione, sed
<lb ed="#Qd"/>quia in praelatis maxime esset periculosum, si
<lb ed="#Qd"/>quaecumque delatio admitteretur, ideo inquisi<lb ed="#Qd"/>tionem
debet praecedere clamosa insinuatio, ut,

<lb ed="#Qd"/>hoc solum bene agitur ut vita hominum corri<lb ed="#Qd"/>gatur</quote>.
Ergo in processu accusationis male agitur
<lb ed="#Qd"/>nisi agatur ad correctionem; non ergo conve<lb ed="#Qd"/>nienter
distinguunt processus denuntiationis et
<lb ed="#Qd"/>accusationis, quia in uno agitur ad correctionem<!--e-->,
<lb ed="#Qd"/>in alio ad degradationem.

<lb ed="#Qd"/>III. Item, dubitatur: si inquisitionem debet
<lb ed="#Qd"/>praecedere clamosa insinuatio, ergo inquisitionem
<lb ed="#Qd"/>videtur praecedere denuntiatio: non enim videtur
<lb ed="#Qd"/>differre clamosa insinuatio et denuntiatio<!--f-->; ergo
<lb ed="#Qd"/>in processu inquisitionis includitur processus de<lb ed="#Qd"/>nuntiationis.

<lb ed="#Qd"/>IV. Item, quaeritur quantum ad quid intelli<lb ed="#Qd"/>gatur
insinuatio clamosa. Nam si intelligatur

<lb ed="#Qd"/>praelatus descendere ad inquisitionem, cum ta<lb ed="#Qd"/>men

<lb ed="#Qd"/>Ex quibus manifeste probatur quod non solum
<lb ed="#Qd"/>cum subditus, verum etiam cum<!--m--> praelatus ex<lb ed="#Qd"/>cedit,
si per clamorem et famam ad aures supe<lb ed="#Qd"/>rioris
pervenerit, debet coram Ecclesiae seniori<lb ed="#Qd"/>bus
veritatem diligentius perscrutari, ut, si rei

accipitur ex lege <title>Levit.</title> 5<!--o-->, 1, ubi di<lb ed="#Qd"/>citur:
<quote>Anima quae audierit vocem iurantis testisque
<lb ed="#Qd"/>fuerit, quod vidit aut conscius est, nisi indicaverit,
<lb ed="#Qd"/>portabit iniquitatem suam</quote>. Super quem<!--p--> locum
<lb ed="#Qd"/>dicit <name ref="#Augustine">Augustinus</name><!--4--> quod indicari debet ei qui
<lb ed="#Qd"/>potest prodesse et non obesse, cum scilicet est

<lb ed="#Qd"/>unum vel duos, quod si eos<!--s--> non audierit, die
<lb ed="#Qd"/>Ecclesiae</quote>. — Item, processus accusationis
<lb ed="#Qd"/>accipitur ex lege <title>Deuter.</title> 25, 1: <quote>Si causa fuerit
<lb ed="#Qd"/>inter aliquos, ei interpellaverint iudices, quem
<lb ed="#Qd"/>iustum esse perspexerint, illi iustitiae palmam
<lb ed="#Qd"/>dabunt; quem impiam, condemnabunt impietatis</quote>.

severitatem iustitiae, qualis debet esse

se ad talionem; denuntiator vero non, quia
<lb ed="#Qd"/>correctionem intendit secundum misericordiam
<lb ed="#Qd"/>seu pietatem. Praeterea, in<!--b--> inquisitione consi<lb ed="#Qd"/>deratur
discretio veritatis, in denuntiatione affec<lb ed="#Qd"/>tus
caritatis, in accusatione terror severitatis. Se<lb ed="#Qd"/>cundum
hoc ergo<!--c--> dicendum quod in hoc triplici
<lb ed="#Qd"/>processu semper intenditur correctio delinquentis,
<lb ed="#Qd"/>si sit ordinatus processus.

et denuntiatio differunt: nam denuntiatio

vero insinuatio indeterminate<!--d--> per famam.

insinuatio non<!--l--> intelligitur secundum voces

<lb ed="#Qd"/>gravium et honestarum. Unde <name>Innocentius</name> III<!--2-->:
