<lb ed="#Qd"/>Consequens est inquirere de sententiis iudiciorum. Dicitur autem sententia iudi<lb ed="#Qd"/>cialis
tribus modis, proprie, communiter et<!--a--> communissime: proprie sententia
<lb ed="#Qd"/>definitionis, communiter sententia praecepti seu iussionis, communissime sen<lb ed="#Qd"/>tentia<!--b-->
excommunicationis seu punitionis.

<lb ed="#Qd"/>Sententia autem definitionis est ipsa causae determinatio, quae controversiis
<lb ed="#Qd"/>finem imponit pronuntiatione iudicis, absolutionem continens et condemnationem, se<lb ed="#Qd"/>cundum
quod dicit lex humana et etiam divina, <title>Deuter.</title> 25, 1: <quote>Si causa fuerit inter
<lb ed="#Qd"/>aliquos, et interpellaverint iudices, quem iustam<!--c--> esse perspexerint, illi iustitiae palmam
<lb ed="#Qd"/>dabunt<!--d-->, quem impium, condemnabunt impietatis</quote>. Quantum ad primam partem Legis
<lb ed="#Qd"/>ostenditur qualiter sententia iudicis debet continere absolutionem iusti, quantum ad se<lb ed="#Qd"/>cundam
qualiter condemnationem rei.

<lb ed="#Qd"/>Sententia vero praecepti seu iussionis est decretum seu mandatum principis
<lb ed="#Qd"/>seu sacerdotis ex auctoritate iudiciariae potestatis, de qua <title>Deuter.</title> 17, 12: <quote>Sequeris sen<lb ed="#Qd"/>tentiam
sacerdotum et iudicis, qui praesunt loco quem elegerit Dominus; qui autem
<lb ed="#Qd"/>superbierit, nolens obedire sacerdotis imperio et decreto iudicis, morietur</quote>.

<lb ed="#Qd"/>Sententia vero excommunicationis est ex auctoritate iudiciaria separatio
<lb ed="#Qd"/>a communione<!--e--> populi fidelis, quae proprie, quantum ad separationem spiritualem, per<lb ed="#Qd"/>tinet
ad Evangelium, quantum vero<!--f--> ad separationem corporalem et in figura, pertinet
<lb ed="#Qd"/>ad Legem. Separatio autem ista poena est, quae non infertur nisi contumaci. Huiusmodi
<lb ed="#Qd"/>autem exemplum<!--g--> <title>Num.</title> 16, 26, ubi, determinata contumacia Dathan et Abiron, per
<lb ed="#Qd"/>sententiam profert iudex Moyses, dicens: <quote>Recedite a tabernaculis hominum impiorum<!--h-->
<lb ed="#Qd"/>et nolite tangere quae ad eos pertinent ne involvamini in peccatis eorum</quote>. Simili modo
<lb ed="#Qd"/>dicendum quod sententia punitionis est ex auctoritate divinae legis poenae de<lb ed="#Qd"/>linquentis
determinatio.

<lb ed="#Qd"/>Omissis igitur eis quae inquirenda sunt circa sententiam definitionis, quae inqui<lb ed="#Qd"/>sitio
pertinet ad iurisperitos, et iis quae pertinent ad inquisitionem sententiae praecepti,
<lb ed="#Qd"/>quae inquisitio pertinet ad Tractatum de obedientia<!--1-->; omissis insuper iis quae pertinent
<lb ed="#Qd"/>ad inquisitionem sententiae<!--i--> excommunicationis, quae inquisitio proprie pertinet ad iu<lb ed="#Qd"/>dicialia
Novae Legis vel ad quaestionem de clavibus, quantum ad praesentem inquisi<lb ed="#Qd"/>tionem
inquirendum<!--k--> est de sententia punitionis seu legibus per quas poenae mate<lb ed="#Qd"/>riales
determinantur peccatis vel per rationabilem considerationem suspenduntur ut non
<lb ed="#Qd"/>inferantur peccatis.

quaedam in punitionibus.
