This application was developed as part of the EU CitiObs project to support collaborative Citizen Science.
As a proof of concept, this application ensures user authenticity by enforcing a user login when starting the application. Uploading sensor readings to an access control enabled OGC STAplus compliant endpoint ensures lineage from the sensor reading to the original uploading user. This is one important aspect to establish trust in Citizen Science data.
You agree and acknowledge that Secure Dimensions GmbH expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to the implied warranties of merchantability, fitness for a particular purpose and non-infringement.
Secure Dimensions GmbH makes no warranty that the application will meet your requirements, the application will be uninterrupted, timely, secure, or error-free, the results that may be obtained from the use of the application will be accurate or reliable, and any errors in the software will be corrected. You agree and acknowledge that your use of the application is at your sole risk.
The application is provided on an "as is" and "as available" basis. You agree and acknowledge that the use of the application is done at your own discretion and risk. Secure Dimensions GmbH is in no way responsible for any damage to your computer or computer system or loss of data that results from the use. You agree and acknowledge that no advice or information, whether oral or written, obtained by you from Secure Dimensions GmbH or through or from its Site(s) shall create any warranty not expressly stated in the terms.
In no event will Secure Dimensions GmbH be liable for (i) any incidental, consequential, or indirect damages (including, but not limited to, damages for loss of profits, business interruption, loss of programs or information, and the like) arising out of the use of the application. Even if Secure Dimensions GmbH or its authorized representatives have been advised of the possibility of such damages, or (ii) any claim attributable to errors, omissions, or other inaccuracies in the application.
You agree to indemnify, defend and hold harmless Secure Dimensions GmbH as well as its officers, directors, employees, agents, licensors, suppliers and any third party information providers to the website from and against all losses, expenses, damages and costs, including attorneys' fees, resulting from any violation of this Agreement (including negligent or wrongful conduct) by you or your use of the application. Secure Dimensions GmbH reserves the right to release current or past member application user information if Secure Dimensions GmbH believes that a member's account or posting is being used to commit unlawful acts, if the information is subpoenaed and/or if Secure Dimensions GmbH deems it necessary and/or appropriate.
While using the application, you agree to the application's Privacy Statement and must comply with the following:
You are responsible for using the application in compliance with all applicable laws, regulations, and the Terms of Use outlined below.
You shall only use the application to upload sensor readings received from any of your devices.
Under no circumstances you will upload any content that:
- is unlawful or promotes unlawful activities;
- is or contains sexually obscene content;
- is libelous, defamatory, or fraudulent;
- is discriminatory or abusive toward any individual or group;
- gratuitously depicts or glorifies violence, including violent images;
- contains or installs any active malware or exploits, or uses our platform for exploit delivery (such as part of a command and control system); or
- infringes any proprietary right of any party, including patent, trademark, trade secret, copyright, right of publicity, or other right.
- impacts the availability of the uploading application or any other application or application that will read your uploaded content
While using the application, under no circumstances will you
- harass, abuse, threaten, or incite violence towards any individual or group, or other users;
This Agreement shall all be governed and construed in accordance with the laws of the Federal Republic of Germany applicable to agreements made. You agree that any legal action or proceeding for any purpose concerning this Agreement or the parties' obligations hereunder shall be brought exclusively in a federal or state court of competent jurisdiction sitting in the City of Munich, Germany and you hereby expressly consent to the exclusive personal jurisdiction of these courts. You agree and acknowledge that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the application or this Agreement must be filed within one (1) year after such claim or cause of action arose or forever be barred. Any failure by Secure Dimensions GmbH to exercise or enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision. This Agreement contains the entire understanding of the parties hereto relating to the use of this application and supersedes any prior written or oral agreement or understandings between the parties with respect to this application. The invalidity or unenforceability of any provision of this agreement will not affect the validity or enforceability of any other provision of this agreement.
