CONTRAT DE LICENCE DE LOGICIEL 

Le présent document est un contrat (le « contrat ») entre vous et Canon Inc. (« Canon ») régissant votre utilisation des modules logiciels, appartenant à Canon ou à ses concédants de licence, énumérés à l'annexe 1 au présent contrat, qui sont incorporés dans le logiciel Canon « Canon Bubble Jet Print Filter Ver.2.50 for Linux » (Filtre d'impression Bubble Jet Canon version 2.50 pour Linux), « Canon Inkjet Print Filter Ver.2.60 for Linux » (Filtre d'impression Inkjet Canon version 2.60 pour Linux) et « IJ Printer Driver Ver.2.70 for Linux » (Pilote d'imprimante IJ version 2.70 (ou supérieure) pour Linux) (le « logiciel »).

LISEZ ATTENTIVEMENT ET ASSUREZ-VOUS D'AVOIR BIEN COMPRIS L'ENSEMBLE DES DROITS ET DES RESTRICTIONS DÉCRITS DANS LE PRÉSENT CONTRAT AVANT D'UTILISER LE LOGICIEL.

EN UTILISANT LE LOGICIEL DÉCRIT À L'ARTICLE 1 CI-DESSOUS, VOUS RECONNAISSEZ ÊTRE LIÉ PAR LES TERMES DU PRÉSENT CONTRAT.  SI VOUS N'ACCEPTEZ PAS LES TERMES DU PRÉSENT CONTRAT, N'UTILISEZ PAS LE LOGICIEL ET RESTITUEZ-LE DANS LES PLUS BREFS DÉLAIS À L'ENDROIT OÙ VOUS L'AVEZ OBTENU.

1.	LICENCE
Canon vous accorde un droit personnel, limité et non exclusif d'utiliser (« utiliser » signifiant, au sens des présentes, stocker, charger, installer, ouvrir, exécuter ou afficher), de faire utiliser, de copier, de faire copier, de distribuer et de permettre à des tierces parties d'utiliser et de copier le logiciel à seule fin d'une utilisation avec les produits de la gamme d'imprimantes Canon Inkjet et les produits de la gamme MFP Inkjet.  Vous ne pouvez modifier le logiciel que pour votre propre utilisation et vous ne pouvez soumettre le logiciel à une ingénierie inverse que pour déboguer de telles modifications. Vous ne pouvez distribuer le logiciel à une quelconque tierce partie qu'en lui imposant le respect des termes du présent contrat.

2.	RESTRICTIONS
Vous ne pouvez utiliser, céder, sous licencier, vendre, louer, louer en crédit-bail, prêter, transporter ou transférer le logiciel à une tierce partie que dans les conditions expressément autorisées dans le présent contrat.

3.	MENTION DES DROITS D'AUTEUR
Vous ne devez modifier, supprimer ou effacer aucune mention des droits d'auteur de Canon ou de ses bailleurs de licence figurant sur le logiciel ou sur les copies du logiciel.

4.	PROPRIÉTÉ
Canon et ses bailleurs de licence conservent à tous égards les droits, la propriété et les droits de propriété intellectuelle sur le logiciel. En dehors des stipulations expresses du présent contrat, Canon ne vous cède, ni ne vous accorde, par ledit contrat, aucune licence ni aucun droit, exprès ou implicite, sur un quelconque droit de propriété intellectuelle de Canon et de ses concédants.

5.	RESTRICTION À L'EXPORTATION
Vous vous engagez à respecter toutes les lois et réglementations du pays concerné en matière d'exportation et à ne pas exporter ou réexporter, directement ou indirectement, le logiciel en violation de telles lois et réglementations ou sans disposer de toutes les autorisations requises.

6.	ABSENCE DE GARANTIE ET D'INDEMNISATION
LE LOGICIEL EST FOURNI « EN L'ÉTAT », SANS GARANTIE D'AUCUNE SORTE, EXPRESSE OU IMPLICITE ET, NOTAMMENT, SANS GARANTIES IMPLICITES DE VALEUR MARCHANDE ET D'ADÉQUATION À UN BUT PARTICULIER.  VOUS SUPPORTEZ INTÉGRALEMENT LE RISQUE LIÉ À LA QUALITÉ, AU FONCTIONNEMENT ET AUX PERFORMANCES DU LOGICIEL.  SI LE LOGICIEL DEVAIT SE RÉVÉLER DÉFECTUEUX, VOUS SUPPORTERIEZ L'INTÉGRALITÉ DES FRAIS DE MAINTENANCE, DE RÉPARATION OU DE CORRECTION NÉCESSAIRES.

SOUS RESERVE DE LA LÉGISLATION APPLICABLE, CANON, PAS PLUS QUE LES FILIALES OU SOCIÉTÉS AFFILIÉES DE CANON, QUE LEURS DISTRIBUTEURS, REVENDEURS OU QUE LES CONCEDANTS DE LICENCE DE CANON NE SAURAIENT ÊTRE TENUS POUR RESPONSABLES DE QUELQUES DOMMAGES QUE CE SOIT (NOTAMMENT DE MANQUES À GAGNER, DE PERTES DE DONNEES, D'INTERRUPTIONS D'ACTIVITÉ OU D'AUTRES DOMMAGES INDEMNISABLES, INCIDENTS OU CONSÉCUTIFS) OCCASIONNÉS PAR LE LOGICIEL, PAR L'UTILISATION DU LOGICIEL OU PAR L'IMPOSSIBILITÉ D'UTILISER LE LOGICIEL, QUAND BIEN MÊME CANON, LES FILIALES OU SOCIÉTÉS AFFILIÉES DE CANON, LEURS DISTRIBUTEURS, REVENDEURS OU LES CONCEDANTS DE LICENCE DE CANON AURAIENT ÉTÉ AVISÉS DE LA POSSIBILITÉ DE TELS DOMMAGES.

SOUS RESERVE DE LA LÉGISLATION APPLICABLE, VOUS EXONÉREZ PAR LES PRÉSENTES CANON, LES FILIALES ET SOCIÉTÉS AFFILIÉES DE CANON, LEURS DISTRIBUTEURS, REVENDEURS ET LES CONCEDANTS DE LICENCE DE CANON DE TOUTE RESPONSABILITÉ LIÉE À TOUTES REVENDICATIONS CONCERNANT LE LOGICIEL OU SON UTILISATION.

7.	DURÉE DU CONTRAT
Le présent contrat prend effet à compter de votre acceptation dudit contrat, marquée par l'utilisation du logiciel, et reste en vigueur jusqu'à sa résiliation.  Vous pouvez résilier le présent contrat en détruisant le logiciel.  

Canon peut résilier le présent contrat si vous ne respectez pas toutes les clauses du contrat.  En cas d'une telle résiliation du présent contrat, sans préjudice du droit de Canon d'agir pour faire valoir ses droits, vous êtes tenu de détruire le logiciel dans les plus brefs délais.  

Nonobstant les stipulations précédentes, les articles 4 et 6 à 10 du présent contrat continuent de s'appliquer même après la résiliation du présent contrat.

8.	MENTION SUR LES RESTRICTIONS DES DROITS DU GOUVERNEMENT DES ÉTATS-UNIS
Le logiciel représente des « articles commerciaux », au sens de la définition de ce terme sous 48 C.F.R. 2.101 (octobre 1995), composés de « logiciels informatiques commerciaux », au sens de l'utilisation de ces termes sous 48 C.F.R. 12.212 (septembre 1995).  Conformément aux dispositions 48 C.F.R. 12.212 et 48 C.F.R. 227.7202-1 à 227.7202-4 (juin 1995), les utilisateurs finaux du gouvernement des États-Unis ne peuvent acquérir le logiciel qu'avec les droits définis dans le présent contrat.  Le fabricant est Canon Inc./30-2, Shimomaruko 3-chome, Ohta-ku, Tokyo 146-8501, Japon.

9.	DIVISIBILITÉ DU CONTRAT
Au cas où une clause du présent contrat serait déclarée ou jugée illégale par un tribunal compétent, ladite clause serait réputée nulle et non avenue pour la juridiction dudit tribunal et toutes les autres clauses du présent contrat resteraient pleinement en vigueur.

10.	DÉCLARATION
VOUS RECONNAISSEZ QUE LE PRÉSENT CONTRAT REPRÉSENTE LA FORMULATION INTÉGRALE ET EXHAUSTIVE DE LA CONVENTION ENTRE VOUS-MÊME ET CANON RELATIVEMENT À L'OBJET DU PRÉSENT CONTRAT ET QUE LEDIT CONTRAT SE SUBSTITUE À TOUTES PROPOSITIONS OU CONVENTIONS ANTÉRIEURES, VERBALES OU ÉCRITES, ET À TOUS AUTRES ÉCHANGES ENTRE VOUS-MÊME ET CANON RELATIVEMENT À L'OBJET DU PRÉSENT CONTRAT.

Les logiciels Canon « Canon Bubble Jet Print Filter Ver.2.50 for Linux » (Filtre d'impression Bubble Jet Canon version 2.50 pour Linux), « Canon Inkjet Print Filter Ver.2.60 for Linux » (Filtre d'impression Inkjet Canon version 2.60 pour Linux) et « IJ Printer Driver Ver.2.70 for Linux » (Pilote d'imprimante IJ version 2.70 (ou supérieure) pour Linux) contiennent les modules logiciels indiqués aux annexes 2 et 3 aux présentes.

Ces modules logiciels sont des logiciels gratuits, que vous pouvez redistribuer et/ou modifier dans les conditions de la licence publique « GNU General Public License Version 2 » publiée par la Free Software Foundation (« GPL »).
