Some points of note if we want to support digital goods:

Customers in the EU must pay VAT on digital goods at the rate applicable in their own country regardless of where the seller is located. Make sure that your tax settings are correct to sell digital products to customers in the EU. source

Updating this old issue since I don't think anything new is needed to support digital good now.

A digital product would require the following:

Stock level not tracked (usually)
A custom ShippingMethod that is free
An EmailEventHandler which automatically sends the license key/access credentials or whatever when the Order transitions to PaymentSettled.
