You are wrong. This has been discussed already multiple times. Just because its inconvenient for players doesn't mean it's gonna get changed. The behavior is correct for vanilla.

Patch 2.1.0:
Gouge: This ability will no longer trigger poisons (and thus break itself).

This is also the same patch where sap got changed so the rogue remains in stealth.
