Terms and Conditions for Using London Eyes

Welcome to London Eyes, please read the terms and conditions carefully. By using the website or mobile application, you are deemed to have accepted these Terms and Conditions. If you do not agree to these terms of use, please refrain from accessing or using the website and mobile application.
London Eyes is a classifieds platform that offers digital advertising space to its users (buyers, sellers, service providers, and service seekers) and is owned by London Eyes Co.
London Eyes is not responsible for and does not provide any warranty on any product or service advertised on the platform in any way whatsoever, including the sale and purchase operations, the accurate representation of the product or service, and the quality of the product or service. Furthermore, London Eyes is not liable for any claims of compensation for any losses.

I. Ad Placement Rules:

1. Ads can only be posted after a user registration using a verified mobile phone number and email.
2. The advertiser must classify the Ad under the correct section.
3. The advertiser must input the title, description, price, and image of the Ad correctly without any misrepresentations.
4. The advertiser should be the owner of the goods or services being advertised.
5. Any uploaded Ad must not contain any illegal, immoral, or obscene language or images as well as prohibiting any advertisement aimed at defaming persons or institutions.
6. Advertisers may not advertise or display any kind of weaponry, whether licensed or unlicensed.
7. Advertisers may only advertise for one item per listing. Advertising for multiple items requires the creation of a new listing for each item.
8. Placing ads in violation of the laws of advertiser's state or the laws of the UK is prohibited, as well as ads that violate the rules of Islamic Sharia, especially swine products and ads against the general morals.
9. Smoking advertisements of all kinds, regular or electronic, are prohibited.
10. It is prohibited to publish any ads for gambling and betting.
11. It is forbidden to publish any advertisement for wines or spirits of all kinds - and prohibits the publication of any advertisement for drugs and cannabis of all kinds.
12. Placing ads for the display and sale of bugging devices and the means of inciting the misuse of telephone devices is prohibited.
13. Advertising for payments of debts and cashing is prohibited. All ads for attracting investment, calling for investment and commercial partnership are prohibited.
14. The Advertiser of craft works must obtain a license from the official authorities to practice the activity, and users of the application are required to verify the presence of the necessary documents and licenses before contracting with the craft works providers, without any responsibility on London Eyes.
15. London Eyes reserves the right to block any phone number or device that uses the app to offend, harm a third party or use the app for illegal purposes.
16. Users shall respect other visitors and users.
17. Reserving ads or pinning for the purpose of selling it to another party is prohibited.
18. The advertising user shall be liable for any legal liability or compensation, with no liability to London Eyes.
19. The customer confirm acknowledges accessing all special and general conditions using the services of the site and with his full approval and acceptance of it, and decides to bear legal "criminal and civil "responsibility for any damages to the site or those in charge of it or others in case of violating the laws, regulations and decisions regulating the advertisement and all other laws and decisions applicable in the country and entering it on the site or using the services available to it is an acknowledgment and a pledge thereof.
20. London Eyes has the right to block any user that does not comply with the app conditions.

II. Removing Violating Ads and Comments, and Ad Expiry:

1. A free ad, if any, will stay for 5 days.
2. Ads will be automatically removed from the app after the time period set by London Eyes.
3. Non-complying ads will be removed without notifying or compensating the user. The administration has the right to prohibit the non-complying and abusive user from refunding any remaining balance.
4. Once an ad is cancelled, you cannot see it on (My listings) page.
5. London Eyes has the right to block any user who places a non-complying ad or add offensive comments to others through private messages or through (live chat). The administration has the right to block the non-complying user from using the app, temporarily or permanently.

III. Financial Rights:

1. A paid ad price & duration are based on the category the user upload in
2. Cost of any add-ons will be added to the ad cost.
3. When using electronic payment to pay for an ad, you must retain a record of payment, in case you are not credited. London Eyes will only refund in the case that the user has evidence that the transaction was deducted from their bank account.
4. Refunds can only be given to users in case of technical failure in the system occurring after successful payment.
5. Cost of non-complying ads will not be refunded.
6. After purchasing credit, user may not refund the remaining available balance.

IV. Privacy and Sharing Users' Data:
London Eyes protects the confidentiality of users' data. The data will not be shared except within the limits permissible by the sellers when placing each ad, which will be made by inputting the required data in the required fields for the contact information, e.g. phone number and e-mail, taking into account not to place any ad that violates the laws of UK.
The user agrees to provide the concerned authorities with her/his data if requested by the authorities from London Eyes in the case of placing an ad that violates the applicable laws of the UK or by commenting through instant-messages or live chat support in any illegal manner, or in any way that violates these terms and conditions.

V. Intellectual Property Rights:

1. London Eyes owns all app intellectual property rights and all app contents, including data, images, and contents in all forms available on the app and the website.
2. Under no circumstances, may the app’s content or data be attempted to fully, automatically or any material part of it extracted. The content of this app is prohibited to be used in any other intellectual work or included in any electronic database. It is totally prohibited to resell, distribute, modify, translate or re-engineer the contents of this app in any form. London Eyes reserve the full right to impose necessary restrictions to prevent any person or other websites from linking to or extracting the content of this app and website.
3. It is also prohibited to re-engineer or disassemble the program used in the app in order to have access to the original program source code or the original structure of this app or website.

VI. Assigning Rights for Placed Ads and Images:

1. The user is considered to assign the rights of the ad and its attached images to London Eyes once uploaded to the app.
2. London Eyes reserves its right to reuse the images and content posted to ads as it sees fit.

VII. Modifying the Terms and Conditions:
London Eyes has the right to modify these terms and conditions at any time without prior notification. These modifications will be effective once posted to the app or website. Users should read these terms and conditions carefully and regularly to review any modification to them. Continuing the use of this app by the user after modifying the terms and conditions is an expressed approval of these modifications.

شروط وأحكام استخدام (London Eyes)

أهلا بكم في (London Eyes) يرجى قراءة الشروط والأحكام بعناية قبل استخدام الموقع الإلكتروني أو التطبيق، تصفحك أو إضافة أي إعلان لدينا يعتبر إقرار منك بقراءة الشروط والأحكام والموافقة عليها.
تمتلك شركة London Eyes تطبيق وموقع (London Eyes) وهي منصة توفر مساحة للإعلانات لمستخدميها (البائعين والمشترين)، ويقتصر دور (London Eyes) على توفير مساحة لالتقاء البائع والمشتري بصورة ميسرة، ولا تتحمل (London Eyes) أي مسئولية ولا تقدم أي ضمان تجاه المستخدمين فيما يتعلق بعمليات البيع والشراء وجودة المنتجات أو الخدمات. إن استعمالك لـ(London Eyes) يفيد موافقتك الصريحة على التنازل عن أي مطالبة بالتعويض عن أي خسائر تلحقك.

أولا: تعليمات وقواعد نشر الإعلان:

1. يتم إدراج الإعلانات بعد التسجيل برقم الهاتف المحمول والبريد الإلكتروني.
2. يجب على المعلن تصنيف الإعلان ونشره تحت القسم الصحيح.
3. يجب كتابة عنوان للإعلان ووصف المنتج والسعر وإضافة الصور بشكل صحيح ويجب أن تكون السلعة حقيقة وموجودة.
4. يجب أن يكون المعلن هو صاحب السلعة أو الخدمة.
5. يحظر نشر إعلانات تحتوي على ألفاظ أو صور مخالفة للآداب العامة أو غير قانونية كذلك يمنع أي إعلان يهدف للتشهير بالأشخاص او المؤسسات.
6. يحظر نشر إعلانات بيع الأسلحة بجميع أنواعها سواء كانت مرخصة أو غير مرخصة.
7. يكون كل إعلان لسلعة واحدة فقط، وبحال تعدد السلع فيتم إنشاء إعلان مستقل لكل سلعة.
8. يحظر نشر الإعلانات المخالفة للقوانين في دولة منشئ الإعلان، والإعلانات لقوانين المملكة المتحدة والاعلانات المخالفة لأحكام الشريعة الإسلامية وخاصة إعلانات منتجات الخنزير والإعلانات التي تثير الطائفية والمخالفة للأخلاق والآداب العامة.
9. يمنع نشر إعلانات التدخين بكافة أنواعها العادية أو الإلكترونية.
10. يمنع نشر أي إعلان للقمار والمراهنات.
11. يمنع نشر أي إعلان للخمور أو المشروبات الروحية بكافة أنواعها - كما تحظر نشر أي اي اعلان للمخدرات والحشيش بكافة أنواعها.
12. يحظر عرض وبيع أجهزة التنصت ووسائل التحريض على إساءة استعمال أجهزة الهاتف.
13. يحظر الإعلان عن سداد الديون وتكييش القروض وجلب الاستثمار والدعوة للاستثمار والمشاركة التجارية.
14. على ناشر الاعلان الخاص بتقديم الاعمال الحرفية ان يكون حاصلا على ترخيص من الجهات المختصة لمزاولة النشاط، ويرجى من مستخدمي التطبيق التثبت من وجود المستندات والتراخيص اللازمة قبل التعاقد مع مقدمي الأعمال الحرفية، وذلك دون أدنى مسئولية على (London Eyes).
15. تحتفظ إدارة (London Eyes) بحق حظر أي رقم هاتف يستخدم التطبيق في الإساءة أو الأضرار بالغير أو بحال استخدام التطبيق لأغراض غير قانونية.
16. يراعي المستخدم احترام المتصفحين والمستخدمين الآخرين.
17. يمنع حجز الإعلانات أو حجز التثبيت بغرض بيعها لطرف آخر.
18. يتحمل المستخدم ناشر الإعلان أي مسائلة قانونية أو أي تعويض دون ادني مسئولية على (London Eyes).
19. "يقر العميل بالاطلاع على كافة الشروط الخاصة والعامة باستخدام خدمات الموقع وبموافقته التامة عليها وقبوله لها، ويقرر بتحمله المسؤولية القانونية "الجزائية والمدنية " عن أي أضرار تلحق بالموقع أو القائمين عليه أو الغير في حال مخالفة القوانين واللوائح والقرارات المنظمة للإعلان وكافة القوانين والقرارات الأخرى السارية بالبلاد، ويعد دخوله على الموقع أو استخدامه للخدمات المقدمة إقراراً وتعهداً منه بذلك.
20. لإدارة (London Eyes) الحق بمنع أي مستخدم لا يتوافق مع شروط التطبيق.

ثانيا: إزالة الإعلانات والتعليقات المخالفة:

1. مدة الإعلانات المجانية – إن وجدت خمسة أيام - وبعدها يتم يحذف الإعلان.
2. يتم إزالة الإعلان تلقائيا من التطبيق بعد انتهاء الفترة الزمنية المحددة من قبل إدارة (London Eyes).
3. يتم إزالة الإعلانات المخالفة دون إبلاغ المستخدم المخالف ودون تعويضه، ويحق لإدارة التطبيق منع المستخدم المسيء والمخالف من استرداد قيمة الرصيد المتبقي.
4. عند إلغاء الإعلان لن تستطيع مشاهدته بصفحة (قائمتي).
5. يحق لإدارة (London Eyes) منع أي مستخدم ينشر إعلان مخالف أو يضيف تعليقات مسيئة للغير في الرسائل الخاصة أو عن طريق (اللايف شات)، ويحق لإدارة التطبيق منع المخالف من استخدام التطبيق بشكل مؤقت أو نهائي.

ثالثا: الحقوق المالية:

1. قيمة ومدة الإعلان المدفوع تعتمد على القسم المعلن فيه.
2. تضاف قيمة أي مميزات أخرى على قيمة الإعلان.
3. عند استخدام الدفع الالكتروني لدفع قيمة الإعلان يجب الاحتفاظ بسجل للدفع، وبحالة عدم إضافة الرصيد تلتزم إدارة (London Eyes) بتعويض المستخدم بحال وجود دليل على إتمام عملية السداد وخصم المبلغ من الحساب المصرفي للمستخدم.
4. لا يسمح باسترجاع قيمة الإعلان إلا في حالة ثبت وجود خلل في النظام تم بعد السداد.
5. لا يتم استرداد قيمة الإعلانات المخالفة.
6. بعد شراء الرصيد لا يحق للمستخدم استرداد قيمة الرصيد المتوفر.

رابعا: الخصوصية ومشاركة بيانات المستخدمين:
تحرص إدارة (London Eyes) على سرية بيانات المستخدمين، ولا يتم مشاركة البيانات إلا في حدود المسموح به من قبل البائعين عند نشر كل إعلان على حده، ويكون ذلك عبر كتابة البيانات المطلوبة في الحقول الخاصة بالتواصل مثل رقم الهاتف والبريد الإلكتروني، ويراعى عدم نشر أي إعلانات تخالف قوانين المملكة المتحدة، ويوافق المستخدم عند نشر إعلان مخالف للقوانين المعمول بها في المملكة المتحدة أو إضافة تعليقات عن طريق الرسائل الداخلية أو (اللايف شات) على تزويد بياناته للجهات الحكومية المختصة بحال تم طلبها من (London Eyes).

خامسا: حقوق الملكية الفكرية:

1. تمتلك (London Eyes) كافة حقوق الملكية الفكرية المتعلقة بالتطبيق وكذلك كافة محتويات التطبيق بما في ذلك البيانات والصور والمحتويات الفكرية بكافة أشكالها الموجودة على التطبيق وعلى الموقع الإلكتروني.
2. لا يجوز باي حال من الأحوال محاولة اقتباس محتوى التطبيق اقتباسا كاملا أو بطريقة آلية أو جزء جوهري منه. كما يحظر استخدام محتوى هذا التطبيق ضمن أي عمل فكرى أخر أو تضمينه في قاعدة بيانات إلكترونية. كما يحظر تماما أيضا إعادة بيع محتويات هذا التطبيق، أو توزيعه أو التعديل عليه أو ترجمته أو إعادة هندسته بأي صورة. كما تحتفظ (London Eyes) بكامل الحق في أن تضع من القيود ما يلزم لمنع أي شخص أو موقع إلكتروني آخر من ربط أو اقتباس محتوى هذا التطبيق.
3. كما يحظر إعادة هندسة أو تفكيك البرنامج المستخدم في التطبيق بهدف الوصول إلى برنامج المصدر أو الشفرة الأصلية لهذا البرنامج أو الوصول إلى البنية الأصلية لهذا التطبيق.

سادسا: التنازل عن الإعلانات والصور المنشورة:

1. يعتبر المستخدم متنازلاً عن الإعلان والصور المرفقة به فور رفعه على التطبيق.
2. تحتفظ إدارة (London Eyes) بحقها في إعادة استخدام الصور المنشورة في الإعلانات بالشكل الذي تراه مناسب.

سابعا: التعديل على الشروط والأحكام:
يحق لـ (London Eyes) تعديل شروط وأحكام الاستخدام الخاصة بها في أي وقت، وتصبح مثل هذه التعديلات نافذة بمجرد نشرها على تطبيق. وعلى المستخدمين الاطلاع على شروط وأحكام الاستخدام هذه دورياً لغايات مراجعة أي تعديلات تطرأ عليها. ويعتبر استمرار المستخدم باستخدام التطبيق بعد إجراء التعديلات على الشروط والأحكام يعتبر موافقة صريحة منه على تلك التعديلات.
