PatchMatch License

the source code has MIT license. but I always thought that the PatchMatch was somehow owned by Adobe either by patent or other means. Isn't that the case?

if you look here, you'll see somewhere "research non commercial use only". I'd like to use this repo and play around with PatchMatch but I'd like to know the legal aspect of it first.
