The last discussion with the editors was that http was the conical protocol for CC licenses. See the discussion here:

IIIF/api#1874

The current spec recommends http:

https://iiif.io/api/presentation/3.0/#rights

Happy to change the validator if this changes but I think currently it is correct as the spec is written. If you disagree with the http requirement in the spec feel free to submit an issue on the API repo.
