Upload from main navigation bar fails if user has no right to create new collections

user account has no right to create new collections but has been granted the right to "create items" in selected collections.

Selecting "Upload" from the main navigation bar returns the error:
You have no right to create collections, thus you can not upload items!

Result: nok. The message "You have no right to create collections, thus you can not upload items! " is still coming up

I can not reproduce.
The message might happen if the user has no rights to create a collection AND has no upload rights in any collection.
Bugs related to the case: user has no rights to create a collection BUT has upload rights in at least one collection.
I could test both succefully.
Can you give me a concrete example?
