  1. Comment out notice and disclaime;
  2. Add error message to fopen(), because sometimes it failed to create the file in my Ubuntu OS and Matlab gave me inaccurate error message.

Hi, the comments issue was fixed with an earlier release. For the next release we have added appropriate error handling code.
