I just updated the copy and closed #29 - anyway, this is a reasonable question. The 100s of repos that make up Atom are under an extremely permissive license, so why not the site? Basically, Atom the editor is an open source project with a big community from all around the world, but Atom is also a GitHub trademark, and we'd prefer to manage the site and marketing ourselves. There are also some tricky things around accepting modifications to trademarked designs and creative work so I think it's best that the core of the site remains closed source for the time being.
