If you going to provide binaries of your own codec with patent license then, I think, nothing prevents your from providing binaries of other open source H.264 encoder - x264 with the same patent licensing terms. It is the best H.264 encoder in existence.

Would it be possible to get the source code to x264 under a license that did not have patent restrictions?

So when I look at x264, the GPL v2 license has

For example, if a patent
license would not permit royalty-free redistribution of the Program by
all those who receive copies directly or indirectly through you, then
the only way you could satisfy both it and this License would be to
refrain entirely from distribution of the Program.

Given that the 264 FAQ has

Does the x264 license include AVC patent royalties?

No, it does not. You will need to get a separate patent license from MPEGLA, see: http://www.mpegla.com for more info .

I'm just not understanding how this works. How would we (or anyone for that matter) be able to distribute that code unless we could get a license to it that was not GPL. If it's possible to talk about getting it on other terms, love to hear about that and someone should drop me an email but for now I'm going to close this issue because because I don't think it is really an issue to do with the code in this repo.
