GitHub is based in and operates in the United States, which follows the DMCA. Under which, reverse engineering a computer program in part or whole is permitted under a few exceptions. These being:

  • to provide a documentation for understanding and learning about the program
  • to achieve interoperability with the program when it is necessary

Blizzard discontinued Diablo almost 10 years ago because it began having compatibility problems on newer systems. That was 10 years ago. Fast forward and now the game hardly runs at all on modern hardware. People have to go to greats lengths to get the game running correctly. Some even resort to Virtual Machines. Devilution is providing a documention of the original design in whole, so that users may achieve compatibility with the software they so legally paid for.

..and reporting to Github admins and hope Blizzard takes action as well.

Blizzard already knows about it, or it would've been shut down already. They sent me an email almost a week after the project was put online and said they thought it was impressive and they needed people with that kind of dedication. They also mentioned that it caught the interest of the Diablo team.

Blizzard never discontinued Diablo, that is a lie. Their servers are still running even today.

Diablo 1 has been discontinued for quite some time now. You'd have to find a retailer somewhere still carrying it I'm afraid. The same goes for Hellfire which isn't actually a Blizzard product.

There are no options to add the game to a Battle.net account on the website because the game has been discontinued. We do not offer a download for Diablo 1. If you are able to get the game running, great! But be aware that it's no longer supported.
