after investigation & testing found out with emulator and test device, that with 8.1 when you don't move a pointer you get a pointer up event immediately (you have to move the pointer at least once to force no instant pointer up)

can't fix - no workaround
-> the time till automatic touchend is triggered is the new max energy time
