Using the "Save as XHTML 5 (Source)" with Firefox 19, observed most recently on https://dvcs.w3.org/hg/IndieUI/raw-file/tip/src/indie-ui-events.html but have seen on other Respec-based documents as well.

Respec outputs a meta tag for character encoding. However the http-equiv attribute is "Content-type" when it should be "Content-Type" to match the HTTP header. This causes docs to fail validation.

That's not a problem generated by ReSpec, the error is in your source document. If you fix that, you'll be good.
