Although 3.1 was added only in TrueCrypt 7.2, it's clear that the author(s)' intentions are to make the license less restrictive for others who wish to pick up development. You're probably safe in using the newer license for 7.1a.
I really doubt the author(s) will burn their anonymity to go after you for using the new license they wrote themselves.

Unlike #2, this is the only other license that you are probably legally allowed to use. #2 is about performing something that you cannot legally do (using a popular license; e.g. MIT/BSD/Apache/GPL).
