When actively recognizing from the microphone, this will make requests every few seconds in order to recognize the continuous stream of sound, mostly I think as the original Shazam app does.

If you are willing to make massive/automated recognizing of songs against a pre-defined registry of songs, I'd suggest to check the law applicable to scraping/database rights in your country, such as directive 96/9/EC in Europe.
