Just started failing recently; possibly a different code path with updated gems (for instance, puppetlabs_spec_helpers recently bumped from 2.16 to 4+).

I've got very little experience contributing fixes so please bear with me.
This seems like a hackish 'fix' but it does prevent the /etc/init.d/ files from getting deleted/recreated every time puppet runs.
