Quick attempt to try and fix failing tests in py 3.13.
Potentially a change in behaviour for pytest? Happy from anyone else to look into cleaning up these tests -- not sure class tests funcs is the way to go. Maybe we are better off with fixtures? Or laborious setup for each test. Usability over elegance...
