Windows 11 46 GUI Version, can't select some of the image files detected as duplicates

For some reason, in the image comparison tool, it detects the duplicate images brilliantly. But, in a lot of the groups (which are almost all pairs as I expected) one of the two images has the tick box greyed out and sometimes it will be the copy that is clearly the better quality original. Why would this need to be locked out? If I can't select which image I want to delete, there's no usefulness to this.
