cgroups mountpoint does not exist

I'm starting to see this where I use the action - I have tried various ubuntu versions and singularity versions and no fix so far:

FATAL:   container creation failed: failed to apply cgroups resources restriction: cgroups: cgroup mountpoint does not exist
FATAL:   while running /home/runner/go/src/github.com/hpcng/singularity/prefix/libexec/singularity/bin/starter: exit status 255
