code folding fails with blank line

Pretty easy

def foo():
....pass
....
....pass

folds correctly, while

def foo():
....pass

....pass

does not, and just folds until the blank line (sees dot as spaces).
Of course I can add spaces, but my editor is configured to remove any ending spaces.

I am sorry it is a bit more subtle, as in some files it works, while in others it does not. I have to find the context that scrambles the code folding algorithm.
