TOS Compliance Review Needed
Context
Scribe uses Anthropic (Claude) and OpenAI APIs to generate SEO articles for customers. Need to ensure our product and customer usage complies with both providers TOS.
Key Areas to Review
1. AI Disclosure Requirement (HIGH PRIORITY)
- OpenAI TOS: Cannot represent Output as human-generated when it is not
- Anthropic AUP: Cannot impersonate a human by presenting results as human-generated
- Action: Add optional AI disclosure setting in platform. Include in our TOS that customers are responsible for AI disclosure compliance in their jurisdiction.
2. Spam / Mass Content Concerns (MEDIUM)
- OpenAI prohibits spam and deceit under usage policies
- Mass-generated thin SEO content could be flagged
- Mitigation: Our quality gate (1000+ words, real value, proper SEO) keeps us compliant. Document this.
3. Impersonation / Attribution (MEDIUM)
- Both providers prohibit creating fake personas to mislead about content origin
- Action: Articles must be attributed to actual brand/person, not fake authors
4. No Competing Models (LOW RISK)
- Both prohibit using outputs to train competing AI models
- We build ON their APIs, not a competing LLM — no issue here
5. Content Ownership (CLEAR)
- Both providers assign output ownership to customer via API
- Anthropic will not train on customer content from API services
- OpenAI Business Terms do not train on API data by default
